Governor Josh Green has nominated Kanwardeep Kaleka for a position on the Mental Health and Substance Abuse, Kaua'i Service Area Board, with a term ending June 30, 2030. Requires all public schools, including public charter schools, to maintain a stock supply of opioid antagonists. Requires the Department of Education and State Public Charter School Commission to offer training to school employees on the administration of opioid antagonists.
Authorizes licensed paramedics in a county with a population of 100,000 or less to administer buprenorphine after administration of an opioid antagonist in cases of opioid overdoses, under certain conditions. Requires the Department of Health to implement a two-year phased pilot program beginning in one county with a population of 100,000 or less and authorizes expansion of the program statewide as additional treatment resources become available. Establishes a comprehensive regulatory framework for prior authorization process in the State, including disclosure and notice requirements for utilization review entities regarding their prior authorization requirements and restrictions; qualifications and criteria for prior authorization review and appeals personnel; prior authorization process for non-urgent and urgent health care services, including the time frame by which utilization review entities must render a decision; adverse determination and appeal processes; prohibition of prior authorization for emergency health care services and medication for opioid use disorder; payments to health care providers; length and duration of prior authorizations; and exemptions for certain health care providers. Requires health insurers to utilize NCPDP SCRIPT Standard electronic prior authorization transactions by 1/1/2026. Requires utilization review entities to submit annual reports to the Insurance Commissioner each year. Requires the Insurance Commissioner to submit annual reports to the Legislature. Requires the Insurance Commissioner to adopt rules by 1/1/2026.
Clarifies the procedures for assisted community treatment, examination, and hospitalization for individuals who may be mentally ill or suffering from substance abuse who are imminently dangerous to self, others, or property. Amends the procedures for involuntary hospitalizations and assisted community treatment petitions. Amends the Hawaii Penal Code to streamline the determination process for penal responsibility and fitness to proceed, including requiring courts to issue orders for treatment to defendants excluded from penal responsibility due to a mental disease, disorder, or defect.

Amends section 353-64, HRS, to include participation in correctional programs for parole eligibility: (1) treatment (substance abuse, mental health, sex offender); (2) work furlough as part of vocational education; and (3) other programs designed to assist the committed person with successful reintegration back into the community; all of which are in the scope of programs determined by Department of Corrections and Rehabilitation's Receiving and Diagnostic (RAD) assessments and recommended for parole eligibility.
