Public Records; Provides public records exemption for certain investigations by AG, DLA, or law enforcement agency into violations of social media actions; provides confidential & exempt information may be disclosed under specified conditions; provides for future legislative review & repeal of exemptions; provides statement of public necessity.
Tobacco and Nicotine Products; Revises age restrictions relating to mail order, Internet, & remote sales of tobacco & nicotine products; expands authority of tobacco product enforcement officers to include nicotine products; revises signage requirements; preempts establishment of minimum age for purchasing or possessing tobacco or nicotine products to state; requires retail nicotine products dealers to obtain permit; provides restrictions on sale or delivery of nicotine products; provides civil & criminal penalties.
Cybersecurity; Requiring certain audit plans of an inspector general to include certain information; providing that the Department of Management Services, acting through the Florida Digital Service, is the lead entity for the purpose of certain responsibilities; requiring the department, through the Florida Digital Service, to track the implementation by state agencies of certain plans; creating the Florida Cybersecurity Advisory Council within the Department of Management Services; requiring the council to provide certain assistance to the Florida Digital Service; providing for the membership of the council, etc.
Genetic Counseling Patient Protection Act; Requires licensure to practice genetic counseling; provides licensure, licensure renewal, & continuing education requirements; prohibits certain acts; provides penalties & grounds for disciplinary action; authorizes DOH to enter certain orders; provides appropriations. APPROPRIATION: $45,964
Elections; Revises & provides provisions relating to voter registration applications, voter registration, elections and terms of county commissioners, ballots, voting systems, duplicate copies of ballots, audits, reports, vote-by-mail ballots, canvassing board duties, certain notifications, voter signatures, secure drop boxes, and penalties.
Estates and Trusts; Revises provisions relating to estates, trusts, dissolution of marriage, trustees, & homestead property; creates "Florida Uniform Directed Trust Act"; creates "Community Property Trust Act".
Public Accountancy; Requires certain applicants to not be licensed in any state or territory in order to be licensed by endorsement; provides license renewal requirements for nonresident licensees; provides requirements for continuing education.
Specialty License Plates; Authorizes credit for or refund of annual use fee if specified condition is met; provides that DHSMV may not issue new specialty license plates until sufficient number of plates are discontinued; provides exception to requirement that specialty license plate annual use fees & interest earned from those fees only be expended in this state; requires DHSMV to discontinue independent college or university's existing specialty license plate if college or university elects to use standard template specialty license plate; requires DHSMV to develop specified specialty license plates; provides for distribution & use of fees collected from sale of such plates.
Emergency Management; Revises & creates emergency management provisions relating to transfer & expenditure of moneys in Emergency Preparedness & Response Fund; state comprehensive emergency management plan; statewide awareness & education programs; personal protection equipment; contracts with providers for care of persons with disabilities or limitations; duration of emergency orders & rules issued by Governor; agency disaster preparedness plans; agency & political subdivision spending plans; emergency orders; emergency mitigation studies; DOH public health emergency plan; collection & reporting & publication of information by State Health Officer; & functions of district medical examiners.
Child Welfare; Revises provisions relating to child welfare, including central abuse hotline, reporting requirements, multiagency teams & investigations, protective investigations involving sexual abuse, access to records & confidentiality, institutional investigation requirements, child advocacy centers, training, living arrangements for young adults, foster home capacity, & alternative plan for contracting with lead agencies; authorizes creation of multidisciplinary legal representation program model for specified purposes; establishes process for handling conflicts of interest by managing entities & lead agencies; requires DCF to publish information on its website & submit report to Governor & Legislature.
Motor Vehicle Rentals; Provides requirements for sales taxes & surcharges on motor vehicle leases & rentals by motor vehicle rental companies & peer-to-peer car-sharing programs; specifies insurance requirements for shared vehicle owners & shared vehicle drivers; provides for liability; provides for exclusions; provides right of recovery to shared vehicle owner's insurer for certain claims; requires provision of certain information regarding liens; specifies recordkeeping, record-sharing, disclosure, & driver license verification & data retention requirements; provides for consumer protections.
Limitation of Liability for Voluntary Engineering or Architectural Services; Defines term "structures specialist"; exempts engineers, architects, & structures specialists from liability for certain voluntary engineering or architectural services under certain circumstances.
