Telephone Solicitation; Prohibits telephonic sales calls without prior express written consent of called party; provides requirements for written consent agreements; provides that called party may revoke express written consent; provides rebuttable presumption for telephonic sales calls made to specified area codes; removes requirement that telephone numbers be excluded from calls made by automated telephone dialing systems with live messages; prohibits commercial telephone solicitation phone calls.
Broadband Internet Infrastructure; Creating the "Florida Broadband Deployment Act of 2021"; requiring municipal electric utilities to provide a specified promotional rate to broadband providers for wireline attachments made in unserved or underserved areas within the utility’s service area; requiring municipal electric utilities to provide certain information regarding connections made available to broadband providers to the Office of Broadband within the Department of Economic Opportunity; requiring the local technology planning teams within the office to provide support to rural communities regarding broadband service availability; requiring wireline attachments to comply with certain safety and engineering standards, etc.
Pub. Rec./Aquaculture Records; Creates exemption from public records requirements for certain aquaculture records; authorizes disclosure of such records under certain conditions; provides for future legislative review & repeal; provides statement of public necessity.
Anchoring Limitation Areas; Grandfathers certain areas as anchoring limitation areas; authorizes local governments to establish anchoring limitation areas; revises provisions prohibiting & authorizing anchoring of vessels in anchoring limitation areas; provides for vessel owners & operators to present certain proof that vessel has not exceeded certain anchoring limitations; revises provisions authorizing removal & impoundment of certain vessels from anchoring limitation areas; declaring that certain vessels are public nuisance; directs FWCC to adopt specified rules.
Renewable Energy; Defines "biogas" & "renewable natural gas"; authorizes PSC to approve cost recovery by gas public utilities for contracts for purchase of renewable natural gas if specified conditions are met; revises term "renewable energy" to include renewable natural gas.
Insurance; Prohibits contractor from executing contract with residential property owner for roofing repair or replacement unless certain notice is included; revises Citizens Property Insurance Corporation to include costs of catastrophe reinsurance to its projected 100-year probable maximum loss in its rate calculations; requires corporation to annually implement rate increase that does not exceed certain percent for specified years; requires corporation's budget allocations for salaries for corporation's employees, all employee raises exceeding 10 percent, & employee compensation plan for corporation to be approved by corporation's board of governors; provides that, for award of attorney fees for claim under property insurance policy, application of contingency risk multiplier may be considered only if certain factors have been met; requires written acceptance of actual cash value coverage in homeowner's policy.
Department of Transportation; Revises provisions relating to transfer of moneys to & from State Transportation Trust Fund; removes requirements related to deduction of service charges; requires DOT to allow person to appear remotely before Commercial Motor Vehicle Review Board via communications media technology; requires DOT to adopt rules to implement airport zoning provisions; requires department, when proposing certain projects on State Highway System, to provide notice to affected property owners, municipalities, & counties; provides public meeting requirements; removes expiration of provisions authorizing LBC to authorize approval of work program amendments; revises date by which M.P.O. must submit list of project priorities to DOT district.
Children and Young Adults in Out-of-home Care; Revises & creates provisions relating to children & young adults in out-of-home care, including case record face sheets; postdisposition changes of custody; placement of children in out-of-home care; child & family teams; placing siblings in same out-of-home placement; Office of Continuing Care responsibilities; judicial review hearings; reinstatement of parental rights; community-based care lead agencies & the Independent Living Services Advisory Council responsibilities; requirements of the Florida Institute for Child Welfare.
Sponsorship Identification Disclaimers; Establishes sponsorship identification disclaimer requirements for certain text messages; modifies existing requirements governing telephone call disclaimers; requires specified persons & organizations sending paid text messages to have & maintain registered agent; provides penalties.
Fish and Wildlife Conservation Commission Trust Funds; Revises sources & use of funds for Florida Panther Research & Management Trust Fund; authorizes FWCC to invest & reinvest funds & interest of Marine Resources Conservation Trust Fund, Nongame Wildlife Trust Fund, State Game Trust Fund, Save Manatee Trust Fund, & Invasive Plant Control Trust Fund; revises use of certain funding sources for Save Manatee Trust Fund.
County and Municipal Code Enforcement; Prohibits code inspectors and code enforcement officers from initiating investigations or initiating enforcement proceedings of potential violations of codes & ordinances by way of anonymous complaints; requires complainants to provide specified information to report potential code or ordinance violations; specifies actions local government may take if person falsely claims fear of retaliation or status-based legal jeopardy to make false complaint.
Information Technology Procurement; Requiring the Department of Management Services, through the Florida Digital Service, to establish certain project management and oversight standards for state agency compliance; requiring the department to perform project oversight on information technology projects that have total project costs of a certain amount or more; authorizing the department to execute certain contracts if the Secretary of Management Services and the state chief information officer certify certain information in writing, etc.
