SB 50: AN ACT TO AMEND TITLE 14 AND TITLE 29 OF THE DELAWARE CODE RELATING TO THE ESTABLISHMENT OF A COMMUNITY COLLEGE INFRASTRUCTURE FUND.

Delaware's Community College System, operated by Delaware Technical and Community College (“the College”), plays a critical role in the State's economy by providing workforce development and transfer education that connects Delawareans with good paying jobs within the State and region. This Act gives the College’s Board of Trustees the authority to issue bonds to finance the cost of major and minor capital improvements, deferred maintenance, and the acquisition of related equipment and educational technology and establishes the Community College Infrastructure Fund (“the Fund”) to pay the principal and interest on such bonds. This Act adopts the county Vo-Tech structure to finance the Fund by authorizing the College's Board of Trustees to collect a local property tax, subject to a cap. All money raised in a county must be placed in a segregated account and spent exclusively on projects in that county; this eliminates any possibility of applying this Act in an unconstitutional manner. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.

HB 10: AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO RECESS AND LUNCH PERIODS FOR KINDERGARTEN THROUGH 8TH GRADE STUDENTS.

This Act entitles all students from kindergarten through the 8th grade who are enrolled in a Delaware public school to morning and afternoon recess periods and a lunch period that is at least 30 minutes in length. Morning and afternoon break periods must be at least 10 minutes in length each. Under this Act, students are entitled to morning and afternoon breaks and a lunch period only on a full day of school.

HB 244: AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DELAWARE DEPARTMENT OF TRANSPORTATION AND THE PREVAILING WAGE ACT.

This bill creates a 3-year exemption for DelDOT road construction from prevailing wage requirements. Also DelDOT will prepare cost study comparison reports for the Controller General's Office to compile and report to the General Assembly.

HB 250: AN ACT TO AMEND TITLE 30 OF THE DELAWARE CODE RELATING TO OPIOID TAX.

This Act imposes a tax on the first sale of opioids in the State at a rate of 10% of the purchase price. Prescription drugs used exclusively for the treatment of opioid addiction are excluded from the tax.

SB 100: AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO COVERAGE FOR SERIOUS MENTAL ILLNESS AND DRUG AND ALCOHOL DEPENDENCY.

Individuals who receive health care via Medicaid deserve the same dedication to treatment of substance abuse disorders as individuals who receive health care via private insurance. This Act extends the same access to treatment of a substance use disorder within the Medicaid framework that Senate Bill 41 of the 149th General Assembly afforded to individuals covered by private health insurance. This Act also clarifies that Medicaid health plans must use the full set of American Society of Addiction Medicine criteria when determining whether “medical necessity” exists for the placement, continued stay, and transfer/discharge of patients with a substance use disorder in treatment programs. Additionally, this Act aligns protections relating to services, specifically 5 days of treatment in detox centers and 30 days of treatment in Intensive Outpatient Programs, with the residential treatment option that is protected pursuant to Senate Bill 41 of the 149th General Assembly.

SB 121: AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO INFORMATION REPORTED TO THE STATE BUREAU OF IDENTIFICATION.

This bill requires the Family Court of the State of Delaware to report adjudications of delinquency involving physical or sexual assault crimes, which are defined in this bill as they are in Title 31 of the Delaware Code, section 309, governing background checks for child-serving entities. These crimes include: reckless endangering in the first degree; abuse of a pregnant female in the second degree; abuse of a pregnant female in the first degree; strangulation; assault in the second degree; assault in the first degree; vehicular assault in the first degree; vehicular homicide in the second degree; vehicular homicide in the first degree; criminally negligent homicide; manslaughter; murder by abuse or neglect in the second degree; murder by abuse or neglect in the first degree; and murder in the second degree; murder in the first degree; promoting suicide; abortion; unlawful sexual contact in the second degree; unlawful sexual contact in the first degree.

HB 131: AN ACT TO AMEND TITLE 25 OF THE DELAWARE CODE RELATING TO MANUFACTURED HOUSING.

This bill sets forth the framework by which a homeowner will pay the disputed rent increase amount to the community owner until final resolution of the rent increase dispute. The community owner must keep each payment of the disputed rent increase amount in an escrow account in a federally-insured banking institution and provide in writing the location of the account to the Delaware Manufactured Home Relocation Authority (Authority) and the Consumer Protection Unit of the Attorney General’s Office and the account number within 30 days of the first dispute rent increase payment. This bill prohibits the community owner from using the escrowed funds for any purpose not expressly permitted by this subsection. This bill requires the community owner to maintain a separate escrow account for each community owned and financial records such that the Consumer Protection Unit can audit such records. This bill provides penalties if the community owner fails to provide the location of the escrow account or place the rent increase dispute payments into an escrow account at a federally-insured banking institution. The bill provides that upon final resolution, if the rent increase dispute resolves in favor of the home owner, then the community owner must return the disputed rent increase held in the escrow account including any interest. If the community owner prevails, then the community owner is entitled to the dispute rent increase amount held in the escrow account plus any accrued interest.

SB 89: AN ACT TO AMEND TITLE 10 OF THE DELAWARE CODE RELATING TO JUDICIAL PROCEDURES.

This Act is modeled after American Laws for American Courts legislation that has passed in Tennessee, Louisiana, Arizona, Kansas, South Dakota, Alabama, and North Carolina. The Declaration of Independence announced the formation of a new country that would no longer find itself in the clutches of a foreign power. For more than two centuries, hundreds of thousands of men and women have given their lives to protect America’s sovereignty and freedom. America has unique values of liberty which do not exist in all foreign legal systems such as freedom of religion, speech, and press, due process, and the right to privacy. Unfortunately, because state legislatures have generally not been explicit about what their public policy is relative to foreign laws, the courts and the parties litigating in those courts are left to their own devices. State legislatures play a vital role in preserving fundamental constitutional rights and American values of liberty and freedom. No United States citizen or resident should be denied these guaranteed liberties, rights, and freedom.

HB 223: AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO DONATION BINS.

This bill places restrictions on the placement of clothing bins. The bill requires a person who places a clothing bin on a property to first obtain a permit from the Department of Health and Social Services before placing the bin.
