SB 53: AN ACT TO AMEND TITLE 8 OF THE DELAWARE CODE RELATNG TO THE GENERAL CORPORATION LAW.

Delaware has consistently been regarded as the preeminent state nationwide with regards to its treatment of corporations due to the fact that the Delaware Corporate Code has continued to evolve in a way to ensure fairness in the treatment of corporations that choose to incorporate in Delaware. Recent cases have brought to light the fact that portions of the Delaware Corporate Code are deficient in providing fair and equitable remedies in specific regards to deadlock situations. In an attempt to maintain preeminence in the realm of corporate law and to ensure the continued fair and equitable treatment of corporations in Delaware, this bill provides that the Court of Chancery may only appoint a custodian to dissolve or sell a solvent corporation to resolve deadlock if (1) alternative remedies prove insufficient after three years or (2) unless the necessary parties stipulate to such a sale.

This concurrent resolution establishes the Medicaid Cost Efficiency Task Force to study and make findings and recommendations regarding Delaware’s Medicaid program.

HB 267: AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO THE REMOVAL OF MOTOR VEHICLES FROM PRIVATE PROPERTY.

This Act is intended to create minimum standards for nonconsensual towing or removing of vehicles from private parking areas. These standards include providing vehicle owners with proper notice that their vehicle may be subject to tow or removal, where their vehicle will be taken, the contact information for the tow or storage company in possession of their vehicle and the maximum rates they can be charged pursuant to the chapter. This Act also extends the amount of time a tower or storage facility must possess a vehicle before selling it.

HB 290: AN ACT RELATING TO THE CONTINUANCE AND MAKING OF APPROPRIATIONS FOR THE EXPENSE OF THE STATE GOVERNMENT AFTER JUNE 30, 2017, ON A TEMPORARY BASIS AND CONTINUING IN EFFECT THE PROVISIONS OF THE APPROPRIATION ACT FOR THE FISCAL YEAR ENDING JUNE 30, 2017, CHAPTER 298, VOLUME 80 OF THE LAWS OF DELAWARE, AND FOR GRANTING AUTHORITY TO CONTINUE APPROPRIATION LINES IN THE APPROPRIATION ACT FOR THE FISCAL YEAR ENDING JUNE 30, 2017, THE BOND AND CAPITAL IMPROVEMENTS ACT FOR THE FISCAL YEAR ENDING JUNE 30, 2017, CHAPTER 299, VOLUME 80 OF THE LAWS OF DELAWARE, AND THE GRANTS-IN-AID ACT FOR THE FISCAL YEAR ENDING JUNE 30, 2017, CHAPTER 300, VOLUME 80 OF THE LAWS OF DELAWARE.

This Act provides for the expense of State government after June 30, 2017, on a temporary basis as appropriated under the Fiscal Year 2017 Budget and for granting authority to continue appropriation lines in the Fiscal Year 2017 Budget, the Fiscal Year 2017 Bond and Capital Improvements Act, and the Fiscal Year 2017 Grants-in-Aid Act.

HB 107: AN ACT TO AMEND TITLE 30 OF THE DELAWARE CODE RELATING TO PERSONAL INCOME TAX.

This bill creates two new tax brackets at $125,000 with a rate of 7.10%, and $250,000 with a rate of 7.85%. Also, the bill provides a tiered reduction of the otherwise available itemized deduction based upon the individual's taxable income.

HB 130: AN ACT TO AMEND TITLE 30 OF THE DELAWARE CODE RELATING TO LODGING TAX.

This bill makes the lodging tax apply to all hotels, motels, tourist homes, and short-term rentals. Short-term rentals are defined as being a room, dwelling, unit, or campground site being rented to overnight guests for a period of 120 days or less for any calendar year and the room or unit is not the owner’s permanent residence.

HB 109: AN ACT TO AMEND TITLE 30 OF THE DELAWARE CODE RELATING TO PERSONAL INCOME TAX.

This bill lowers the current tax rate by .05% for each bracket. The bill creates a new tax bracket at $125,000 with a rate of 7.05% and an additional bracket at $250,000 with a rate of 7.80%. The bill also provides a tiered reduction of the otherwise available itemized deduction based upon the individual's taxable income.

HB 264: AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO UNFAIR PRACTICES IN THE INSURANCE BUSINESS.

This Act requires insurance companies to pay the insured the amount of the insurance company's offer of settlement which was rejected by the insured party. However, the amount remains subject to both parties' reservation or rights, claims, and arguments for the ultimate outcome of the claim.

HB 262: AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO UNFAIR PRACTICES IN THE INSURANCE BUSINESS.

This Act prohibits insurance companies from revoking, or attempting to revoke, an offer of settlement made to an insured, except in circumstances where the insurer reasonably believes the insured has committed fraud against the insurer.

SB 112: AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO THE DELAWARE STUDENT ENTREPRENEUR PLATFORM.

This Act creates the Delaware Student Entrepreneur Program Fund. The primary purposes of the Act are as follows: (1) To attract and retain high-skilled, entrepreneurs, including immigrants to the United States, that graduated from Delaware higher education institutions (2) To help fund and develop new businesses in Delaware and create job opportunities in Delaware for Delaware’s young citizens in the areas of innovation and technology that are poised to grow in the 21st century economy; (3) To attract global entrepreneurs to Delaware higher education institutions, to grow businesses, create jobs in Delaware, and provide employment opportunities for the graduates from these institutions; and (4) To support entrepreneurship and innovation in Delaware.
