If the federal government (CMS) issues a sanction for the same violation, the state sanction is nullified, and any state-collected penalties must be refunded within 60 days.

Facilities must submit and comply with a plan of correction before any sanctions can be imposed, and the Commissioner may extend this correction period.

The maximum civil penalty was reduced from $1,000 per day to $500 per day, and the total cap was lowered from $100,000 to $10,000.

The deadline for the State Board of Health to promulgate implementing regulations was changed from a 280-day limit to a specific start date of July 1, 2025.
