Equipment supplier coverage in subsection (d)(3) was expanded from 'generation and transmission' to 'generation, transmission, and distribution,' bringing distribution equipment suppliers within the scope of the state energy security plan requirements.
In subsection (f), the word 'may' was changed to 'shall,' making a Secretary action mandatory rather than discretionary. This likely relates to the provision for federal assistance to states revising their plans.
A new paragraph (2) titled 'State determination' was added to subsection (e), clarifying that a state's submission of its energy security plan is not required to be approved by the Secretary. This removes any potential federal gatekeeping over state plans.
The sunset provision was restructured. Previously it simply changed a date from 2025 to 2030. The new version creates a standalone subsection (i) titled 'Sunset' that sets the expiration date at September 30, 2031, extending the effective period by one year.
A new Section 3 was added requiring the GAO Comptroller General to submit a report to Congress by September 30, 2030 evaluating the efficacy of State energy security plans. The report must include assessments of risk identification and mitigation improvements, recommendations for states and the Secretary, information on federal financial assistance used, an analysis of section 366 implementation, and details on state use of assistance under section 366(f). Protected information is to be included in a non-public annex.
