Parental Data Rights Act

The Parental Data Rights Act (S 564) requires social media companies to collect parent or guardian contact information when a minor under 18 creates an account and notify that parent/guardian about the account. It gives parents the right to access all data their minor child has shared on the platform and to delete the child’s account and associated data. Social media companies must comply with these requests or face lawsuits, including potential triple damages for negligence in notifying parents. The law applies to major platforms offering interactive services (like Facebook or TikTok) and takes effect 180 days after enactment.
