Freedom To Compete Act of 2023
This bill, S 379 (Freedom To Compete Act of 2023), bans most non-compete agreements between employers and employees. It voids all existing non-compete agreements (except for certain exempt roles under section 13(a)(1)) and prohibits employers from creating new ones after the law takes effect. The bill allows employers to still protect trade secrets through separate agreements, but employees can no longer be restricted from working for other employers or in specific geographic areas after leaving a job. The law takes effect 180 days after enactment and applies to disputes arising after that date.
