The National Monument is no longer established immediately upon enactment. It will only be established on the date the Secretary determines that a sufficient quantity of land or interests in land has been acquired to constitute a manageable park unit, with a 30-day Federal Register notice requirement.
Private property protections were simplified from a detailed provision specifically mentioning houses of worship, commercial property, zoning laws, construction, and appearance of non-Federal property to a single general statement that nothing in the Act affects the rights of private property owners within or adjacent to the monument.
Management plan consultation was narrowed from requiring input from the Commission, current and former residents of the Historic Greenwood District, and descendants to only requiring consultation with the Commission. The requirement to submit the completed management plan to Congress (Senate Energy and Natural Resources Committee and House Natural Resources Committee) was removed entirely.
Removed the detailed definition of 'descendant' that specified how one could verify family lineage (by blood, adoption, or marriage) to a Black individual present in the Greenwood District on May 31 or June 1, 1921, using family records, public records, or institutional records.
Removed explicit protections for Oklahoma State University's authority to own, maintain, and administer Standpipe Hill, as well as the requirement that monument administration not interfere with continuing use of that property.
A new provision allows the Secretary to enter into agreements to mark or interpret significant historic or cultural resources or locations on land within the monument boundary.
The 3-year deadline for preparing the management plan now runs from when funds are first made available to carry out the entire Act, rather than from when funds are specifically made available for management plan preparation.
Commission membership criteria for the 7 descendant seats was tightened to require descendants of individuals who 'lived or worked in the Greenwood District of Tulsa in 1921' and added a requirement that appointments be made after consideration of recommendations from interested organizations or individuals.
The boundary map reference was updated from a July 2023 date to an August 2024 date, reflecting a revised proposed boundary.
