S 3421 United States Senate · 118th Congress

LGBTQI Business Equal Credit Enforcement and Investment Act

This bill amends the Equal Credit Opportunity Act to require lenders to collect and report data on loans to LGBTQI-owned businesses. It adds "LGBTQI-owned" to definitions of minority-owned businesses and specifies that lenders must collect data on sexual orientation, gender identity, and intersex status. The bill defines an "LGBTQI-owned business" as one where over 50% of ownership/control and net profit/loss accrues to individuals self-identifying as lesbian, gay, bisexual, transgender, queer, or intersex. This policy change mandates systematic data collection to identify potential credit disparities affecting these businesses, directly impacting lenders subject to the Equal Credit Opportunity Act.
