Fentanyl Trafficking Prevention Act

This bill targets large internet platforms (defined as those with 50 million+ U.S. or 100 million+ global monthly users) that knowingly help facilitate the illegal distribution of opioids, cocaine, or methamphetamine through their services. It imposes criminal penalties of up to $10 million for violations and allows the Attorney General to seek civil penalties of up to $5 million for intentional or reckless facilitation. The bill explicitly protects platforms using end-to-end encryption and prohibits requiring platforms to monitor users or scan content for drug-related activity. It amends the Controlled Substances Act and clarifies that Section 230 of the Communications Act does not block these new liability claims.
