Undocumented noncitizens ineligibility for early release from incarceration establishment; undocumented noncitizens ineligibility for prosecutor-initiated sentence adjustments establishment

SF 320 prohibits undocumented noncitizens incarcerated in Minnesota from qualifying for early release programs or prosecutor-initiated sentence adjustments. The bill amends Minnesota Statutes to explicitly state that undocumented offenders (defined as noncitizens without U.S. immigration approval) are ineligible for supervised release, earned incentive credits, or any program reducing their prison term. It also blocks prosecutors from adjusting sentences for these individuals under Section 609.133. The law applies to all undocumented noncitizens committed to the commissioner of corrections, requiring them to serve their full sentences without early release options.
