Existing law establishes a system of state prisons. Existing law, the Uniform Anatomical Gift Act, sets forth the methods and procedures for a person to become a donor of an anatomical gift. This bill would require an inmate, upon admittance to a state prison, to complete a form through which the inmate would give or deny his or her consent to be an organ and tissue donor upon death.
This measure would request that the President and the Congress of the United States pass the H.R. 2474 that would restore funding for California veterans pursuing higher education.
Existing law provides for the regulation and certification of credit unions by the Commissioner of Financial Institutions. Existing law sets forth the purposes of credit unions and provides that a credit union is a cooperative that conducts its business for the mutual benefit and general welfare of its members. This bill would make nonsubstantive changes to these provisions.
Existing law provides for the county-administered In-Home Supportive Services (IHSS) program, under which qualified aged, blind, and disabled persons are provided with services in order to permit them to remain in their own homes and avoid institutionalization. Existing law permits services to be provided under the IHSS program either through the employment of individual providers, a contract between the county and an entity for the provision of services, the creation by the county of a public authority, or a contract between the county and a nonprofit consortium. Under existing law, the State Department of Social Services is required, in consultation and coordination with county welfare departments, to establish and implement statewide hourly task guidelines and instructions to provide counties with a standard tool for consistently and accurately assessing service needs and authorizing service hours to meet those needs. This bill would require the standardized provider timesheet used to track the work performed by providers of services under this chapter to contain a legal certification, to be signed by the provider and recipient, verifying that the information provided in the timesheet is true and correct. The bill would authorize, in addition to other criminal penalties, the imposition of a specified civil penalty against a person who is convicted of fraud, as defined, resulting from intentional deception or misrepresentation in the provision of timesheet information under the IHSS program.
Existing law prescribes the course of study a pupil is required to complete while in grades 9 to 12, inclusive, in order to receive a diploma of graduation. Existing law authorizes the governing board of a school district to adopt rules specifying additional coursework requirements. Existing law requires each school district maintaining any of grades 7 to 12, inclusive, to offer to all otherwise qualified pupils in those grades a course of study that provides an opportunity for those pupils to attain entry-level employment skills in business or industry upon graduation from high school. This bill would prohibit a school district from adopting a graduation requirement that commences with the 2010–11 school year and requires the completion of additional coursework to meet or exceed the requirements and prerequisites for admission to a 4-year California public university unless the district also requires the completion of a sequence of at least 3 career and technical education courses. However, this provision would not apply to a school district that, by June 30, 2009, has adopted graduation requirements that require the completion of all minimum coursework necessary to meet the requirements and prerequisites for admission to a 4-year California public university. The bill also would make conforming and clarifying changes.
This measure would designate that January 18, 2010, be observed as the official memorial of the late Rev. Dr. Martin Luther King, Jr.'s birth, commemorate Martin Luther King, Jr. Day, the work of Dr. Martin Luther King, Jr., and the Civil Rights Movement in changing public policy in California and in the United States of America.
Existing law requires the State Energy Resources Conservation and Development Commission to administer federal funds pursuant to specified federal programs to eligible entities to reduce fossil fuel emissions, improve energy efficiency, and reduce overall energy use. This bill would require the commission, upon the enactment of the federal Home Star Energy Retrofit Act of 2010, in consultation with the United States Department of Energy, to develop programs that are required by, and that complement, the federal act. The bill would require the commission, in consultation with specified entities, to take specified actions to implement the federal Home Star program. This bill would be repealed on January 1, 2012.
This measure would recognize the 45th Anniversary of the California Land Conservation Act of 1965, otherwise known as the Williamson Act, and would recognize the value to the state of agricultural land conservation contracts.
This measure would declare April 2010 as Financial Aid and Literacy Month to raise public awareness about the need for increased financial literacy.
The Enterprise Zone Act includes, among others, the legislative declaration that it is in the economic interest of the state to have one strong, combined, and business-friendly incentive program to help attract business and industry to the state. This bill would make technical, nonsubstantive changes to this provision.
