Existing law provides for the regulation of various professions and vocations by boards within the Department of Consumer Affairs and for the licensure or registration of individuals in that regard. Existing law authorizes any licensee whose license expired while he or she was on active duty as a member of the California National Guard or the United States Armed Forces to reinstate his or her license without examination or penalty if certain requirements are met. This bill would require the boards described above, with certain exceptions, to waive the renewal fees, continuing education requirements, and other renewal requirements as determined by the board, if any are applicable, of any licensee or registrant who is called to active duty as a member of the United States Armed Forces or the California National Guard if certain requirements are met. The bill would, except as specified, prohibit a licensee or registrant from engaging in any activities requiring a license while a waiver is in effect. The bill would require a licensee or registrant to meet certain renewal requirements within a specified time period after being discharged from active duty service prior to engaging in any activity requiring a license. The bill would require a licensee or registrant to notify the board of his or her discharge from active duty within a specified time period.

Existing law authorizes the Department of Motor Vehicles to issue distinctive license plates for a motor vehicle owned by a current or retired Member of the California Legislature and a Member of the Congress of the United States and requires that the person pay additional fees in addition to the regular fees for an original registration or renewal of registration. Existing law establishes the California Environmental License Plate Fund in the State Treasury and requires, after certain moneys are deducted by the Controller, that the balance of the moneys in the fund be available for expenditure for specific trust purposes. This bill would, beginning January 1, 2014, (1) make the additional fees for these distinctive license plates the same as the fees paid by an applicant for a personalized license plate, (2) make the Member subject to a transfer fee for these distinctive license plates, and (3) require the department to deposit in the California Environmental License Plate Fund all fees received by the department in payment for the issuance, renewal, or transfer of the special license plates authorized under these provisions after the department deducts its costs in administering these provisions.
Existing law establishes the Department of Veterans Affairs, which is responsible for administering various programs and services for the benefit of veterans. This bill would require the Department of Veterans Affairs to develop outcome and related indicators for veterans, for the purpose of assessing the status of veterans in California, for monitoring the quality of programs intended to serve those veterans, and to guide decisionmaking on how to improve those services. This bill would require the department to report to the Senate and Assembly Committees on Veterans Affairs all of the outcome and related indicators developed by the department, recommendations on ways to establish a system for monitoring those indicators on a continual basis, and any regulatory or fiscal barriers that may hinder future progress on the development of a monitoring system, as provided. Under existing law, the information obtained in the administration of the Unemployment Insurance Law is for the exclusive use and information of the Director of Employment Development in the discharge of his or her duties and is not open to the public. However, existing law requires the director to permit the use of specified information for specified purposes, and allows the director to require reimbursement for direct costs incurred. Existing law provides that a person who knowingly accesses, uses, or discloses this confidential information without authorization is guilty of a misdemeanor. This bill would require the Director of Employment Development to permit the receipt of specified information to enable the Department of Veterans Affairs to develop outcome and related indicators for veterans. By providing this information to the Department of Veterans Affairs, this bill would expand the crime related to the unauthorized disclosure of this information, and impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. This bill would incorporate additional changes in Section 1095 of the Unemployment Insurance Code, proposed by AB 174 and SB 691 that would become operative only if this bill and either or both of those bills are chaptered and become effective January 1, 2013, and this bill is chaptered last.
Existing law provides for the conduct of elections generally. Existing law prohibits the use of a voting system for an election unless it has been approved as meeting specified criteria by the Secretary of State prior to the election. Existing law defines a voting system as any mechanical, electromechanical, or electronic system and its software, or any combination of these used to cast or tabulate votes, or both. This bill would exempt from the definition of a "voting system" a ballot marking system. The bill would define a ballot marking system to mean a mechanical, electromechanical, or electronic system and its software that is used for the sole purpose of marking a ballot for a special absentee voter and that is not connected to a voting system at any time. The bill would require the Secretary of State to study and adopt regulations governing the use of ballot marking systems. The bill would establish procedures to govern the approval of ballot marking systems by the Secretary of State. The bill would prohibit the use of a ballot marking system at an election until it has been approved by the Secretary of State as meeting prescribed criteria. This bill would declare that it is to take effect immediately as an urgency statute.
Existing law prescribes various duties for the Department of General Services in connection with development and maintenance of the park around the State Capitol Building. This bill would authorize the Ronald Reagan Centennial Capitol Foundation, in consultation with the Department of General Services, to plan a statue of Ronald Reagan in the State Capitol Building Annex. The bill would require the Department of General Services and the Ronald Reagan Centennial Capitol Foundation to approve the design and any other aspect of the statue. The bill would require that the planning, construction, and maintenance of the statue be funded with private donations through the Ronald Reagan Centennial Capitol Foundation. The bill would prohibit construction of the statue until the Joint Committee on Rules has approved and adopted the plan for the statue, and the Joint Committee on Rules and the Department of Finance have determined that sufficient private funding is available to construct and maintain the statue.
Existing law authorizes a cemetery authority, cemetery corporation or association, or other entity in possession of the cremated remains of a veteran or dependent of a veteran to release the remains to a veterans' remains organization, as defined, for interment after specified conditions are met, including possession of the remains for at least one year. This bill would require the public administrator of a county to make every reasonable effort to determine if the unclaimed remains of a decedent referred to the public administrator belong to a veteran or the dependent of a veteran. The bill would require the public administrator to work with specified entities, including the county veteran service officer, to determine if the remains belong to a veteran or the dependent of a veteran. The bill would require a county veteran service officer who determines that unclaimed remains are those of a veteran or dependent of a veteran, and that the remains meet the criteria for interment by a veterans' remains organization, to report specified information to the Department of Veterans Affairs. This bill would require the department to maintain a list of those unclaimed remains, and make that list available to veterans' remains organizations by phone or in person. By increasing the duties of counties, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.
(1) Existing law, commencing January 1, 2013, establishes rules for the operation of, and requirements for equipment of, an off-highway vehicle, including prohibiting a person who is operating a recreational off-highway vehicle from allowing a passenger to occupy a separate seat location not designed and provided by the manufacturer for a passenger. Existing law, commencing January 1, 2013, prohibits a person operating a recreational off-highway vehicle from riding with a passenger, unless the passenger, among other things, have both feet flat on the floorboard. This bill would delay operation of the prohibition that a person operating a recreational off-highway vehicle shall not allow a passenger to occupy a separate seat location not designed and provided by the manufacturer for a passenger until July 1, 2013, and would eliminate the requirement that both of the passengers feet must be flat on the floorboard. (2) This bill would declare that it is to take effect immediately as an urgency statute.
Existing law establishes the Office of Planning and Research as a coordinating agency in state government for environmental justice programs. This bill would require the office to serve as the state's liaison to the United States Department of Defense in order to facilitate coordination regarding issues that are of significant interest to the state and department, as provided.
Existing law establishes the California Community Colleges, the California State University, and the University of California as the 3 segments of public postsecondary education in this state. The Chancellor of the California Community Colleges, the Chancellor of the California State University, and the President of the University of California serve as the respective chief executive officers of these 3 segments. This bill would require the Chancellor of the California Community Colleges to determine by July 1, 2015, for which courses credit should be awarded for prior military experience, as specified.
Existing law provides for the licensure and regulation of various professions and vocations by boards within the Department of Consumer Affairs. Existing law provides for the issuance of reciprocal licenses in certain fields where the applicant, among other requirements, has a license to practice within that field in another jurisdiction, as specified. Existing law authorizes a licensee to reinstate an expired license without examination or penalty if, among other requirements, the license expired while the licensee was on active duty as a member of the California National Guard or the United States Armed Forces. This bill would require a board within the department to expedite the licensure process for an applicant who holds a license in the same profession or vocation in another jurisdiction and is married to, or in a legal union with, an active duty member of the Armed Forces of the United States who is assigned to a duty station in California under official active duty military orders.
