Upper Los Angeles River and Tributaries Working Group: membership: revitalization plan.

Section 33220(g)(2) was rewritten. Previously, amendments adopted by the conservancy had to be submitted to the Assembly Committee on Water, Parks, and Wildlife and the Senate Committee on Natural Resources and Water, and would not become effective until 30 days after that submission. Now, the working group submits proposed amendments to the conservancy for approval, the conservancy must take action within 60 days of submission, and the amendment becomes effective immediately upon adoption by the conservancy - no legislative committee submission or waiting period is required.

Removed the requirement (former paragraph (g)(3)) that information submitted to the state legislative committees must comply with Section 9795 of the Government Code, since the committee submission step itself was eliminated.

Removed all provisions unrelated to the Upper Los Angeles River Working Group, including: childhood sexual assault corroboration requirements, school finance authority intercept authorization for public debt obligations, emergency apportionment repayment term extension from 20 to 30 years, local entity bond validity actions before judgment entry, and changes to public entity judgment payment (reducing immediate payment from 50% to 25% and extending payment period from 10 to 20 years).

Working group membership cap increased from no more than 24 appointed representatives to no more than 25.

State-mandated local program designation changed from 'yes' to 'no', reflecting the removal of provisions that imposed mandates on local agencies.

Added a new provision requiring the conservancy to take action to adopt proposed amendments to the revitalization plan within 60 days of submission by the working group, with amendments becoming effective immediately upon adoption.

Changed 'his or her' to 'their' for gender-neutral language regarding representative alternates.

Added new Section 1 amending Public Resources Code Section 33220 to increase the Upper Los Angeles River and Tributaries Working Group membership from no more than 23 to no more than 24 appointed representatives, and to require one representative to represent the Los Angeles city council district with the greatest number of Upper Los Angeles River miles.

Removed a provision that made nonsubstantive changes to Planning and Zoning Law general plan requirements, which had been included in the prior version.

Added requirement that the working group meet at least once each year to evaluate and report on implementation of the revitalization plan to the conservancy, and to propose amendments to the plan for adoption. Extended the repayment period for emergency apportionments under Education Code Section 41329.53 from 20 years to 30 years, with the term determined by the Department of Finance in consultation with the school district, county superintendent, and other parties.

Changed judgment payment terms for public entities under Government Code Section 984: nonpunitive damages now require only 25% immediate payment (down from 50%) with the remaining 75% payable over up to 20 years or the judgment-debtor's remaining life expectancy (up from 10 years).

Fiscal committee determination changed from 'no' to 'yes,' indicating the bill now requires fiscal committee approval. State-mandated local program determination changed from 'yes' to 'no.'

Changed approval authority for school district repayment schedules under Education Code Section 41320 from the Superintendent of Public Instruction to the Department of Finance, and corrected gender-neutral language ('his or her' to 'their').

Added Code of Civil Procedure Section 340.1 amendments establishing that claims for childhood sexual assault occurring on or after January 1, 2024 have no statute of limitations, while claims for earlier assaults remain subject to the prior 22-year/discovery-based limitations period.

Added waiver of the administrative claim presentation requirement (Government Code Sections 900 and 910) for childhood sexual assault damage claims, meaning plaintiffs need not present claims to government entities before filing suit.

Added a requirement that claims alleging childhood sexual assault occurred before January 1, 2006 must be supported by clear and convincing corroborating evidence beyond the plaintiff's own testimony. This cutoff date advances one year each subsequent calendar year (e.g., on January 1, 2027 it applies to assaults before January 1, 2007).

Added certificate of merit requirements for plaintiffs age 40 or older filing childhood sexual assault claims, requiring both an attorney declaration and a licensed mental health practitioner declaration (from a non-treating practitioner) confirming reasonable and meritorious cause before a defendant can be served.

Added Doe designation requirements: defendants must be named by fictitious designation until the plaintiff shows corroborative fact, with in camera court review before names are substituted. Certificates of corroborative fact are kept under seal.

Modified Education Code Section 41320 to require school districts to consult the county superintendent and County Office Fiscal Crisis and Management Assistance Team when developing repayment schedules for emergency loans, and to submit those schedules to the Department of Finance (instead of the Superintendent) for approval.

Added treble damages provision for defendants found to have covered up childhood sexual assault, defined as a concerted effort to hide evidence relating to the assault.

Amended Government Code Section 977.8 to allow local public agencies to initiate bond validity actions before a tort judgment has been entered, and to establish a rebuttable presumption of validity for bonds issued to fund outstanding judgments against local taxing entities.

Added new Education Code Chapter 5 (Section 14560 et seq.) authorizing school districts, county offices of education, community college districts, and educational joint powers authorities to elect state or local intercepts to fund public debt obligations, including tort liability. Counties are authorized but not required to participate in local intercepts.
