State Department of Health Care Services: substance abuse treatment: disclosures.

Changed the required content of each violation summary: replaced 'Legal basis for the violation, including citation to statute or regulation' with 'A citation to the relevant statute, regulation, or standard,' and replaced 'Facts supporting the department's decision to issue the violation' with 'A summary of the department's decision to issue the violation.'

Changed the closing language from 'understand the legal and factual basis for the violation' to 'understand the basis for the violation,' removing the explicit reference to legal and factual basis.

The technical amendment to Code of Civil Procedure Section 363 (clarifying that 'action' includes special proceedings of a civil nature) was removed from the bill entirely.

The new provision requires the department to indicate on its website, in a location and font that is easy to see and read, that notices to recovery residences (as defined in Section 11833.05) issued for a violation of Section 11834.30 are NOT included in the public list. This creates a specific exemption for recovery residences.

The bill's scope shifted from a general DHCS transparency measure plus a technical civil procedure fix, to a focused measure on substance abuse treatment facility transparency and consumer disclosure requirements, while retaining the broader DHCS posting requirement in Section 100219.

New provision amends Health and Safety Code Section 11831.5 to require operators of licensed alcoholism or drug abuse recovery/treatment facilities and certified alcohol or other drug programs to include a disclosure on their internet website and intake form paperwork that individuals can check DHCS's website to confirm whether the facility's license has been placed in probationary status, subject to temporary suspension, revoked, or the operator has received a notice of operation in violation of law.

Violations of the new disclosure requirement (subdivision (a) of amended Section 11831.5) are subject to penalty by the department pursuant to Section 11831.7.

The fiscal committee vote changed from 'no' to 'yes,' indicating the bill now has a state-mandated local program or fiscal impact that requires fiscal committee approval.

Removed a redundant instance of the word 'issued' in subdivision (a), changing 'notices issued to recovery residences... issued for a violation' to 'notices issued to recovery residences... for a violation.' This is a grammatical cleanup with no policy effect.

New Section 100219 added to the Health and Safety Code requiring the State Department of Health Care Services to post on its website an identification and summary of each violation issued for every program it administers, in a location easily navigable from a prominently labeled link on the main homepage.

Each posted violation summary must include: the name of the entity or person, the legal basis (statute or regulation citation), facts supporting the decision, the date of issuance, and any other information the department deems necessary for public understanding.

A privacy protection clause was added requiring the department to implement the posting requirement in a way that does not post information violating privacy rights under state or federal law.

The bill's title and scope expanded from solely amending Code of Civil Procedure Section 363 (a technical fix) to also adding a substantive transparency requirement in the Health and Safety Code.
