What changed between versions
New subdivision (a)(2) added to Section 3000.01 explicitly stating that subdivision (h) of Section 3000.08 applies to any person sentenced under Section 1168 for first- or second-degree murder with a maximum term of life imprisonment and released on parole on or after July 1, 2020. This means if such an inmate violates the law or conditions of parole, they will be remanded to CDCR custody and BPH jurisdiction for future parole consideration. The bill states this is declarative of and clarifies existing law.
The exemption in subdivision (d)(2) that excluded inmates sentenced under Section 1168 for first or second degree murder with a maximum term of life imprisonment from the section's application was removed. This means murder inmates are no longer carved out from the parole provisions of Section 3000.01.
The bill's structure was reorganized: the legislative findings and declarations that were in Section 1 of the introduced version were moved to a later position, and the amendment to Section 3000.01 now appears first as Section 1. The legislative counsel's digest was also updated to reflect the amended scope, adding 'Parole: revocation' as a topic.
