District elections: initiatives.

The entire provision amending Section 8589.13 of the Government Code was deleted. This had required the Office of Emergency Services to wait at least 100 days after notifying local agencies before selling firefighting apparatus to out-of-state public agencies, the federal government, or Indian tribes, and included rules on installment payment interest rates and loan insurance.

The accountability standards requirement in Section 9300(b)(2) was changed from 'all spending limitations and accountability standards' to 'all spending limitations and accountability standards, including, but not limited to, a transportation expenditure plan, substantive accountability standards.' The word 'substantive' narrows the obligation.

New clarifying language was added specifying that the transportation expenditure plan must specify the purposes for which tax revenue will be used, but explicitly excludes procedural requirements such as requiring local agencies to approve the transportation expenditure plan.

A new Section 1 amending Elections Code Section 9300 was added, authorizing voters of any district with authority to impose a transactions and use tax for transportation purposes (under Revenue and Taxation Code Part 1.6, commencing with Section 7251) to impose a retail transactions and use tax by initiative measure.

The bill's scope expanded from solely amending Government Code Section 8589.13 (fire equipment sales) to also amending Elections Code Section 9300 (district initiative procedures), making it a two-subject bill.

The new initiative tax provision caps the tax rate at the maximum authorized rate for an ordinance-imposed tax and requires the initiative to include all spending limitations and accountability standards (including a transportation expenditure plan) that apply to ordinance-imposed taxes.

A declaratory statement was added confirming that the initiative tax power implements Section 3 of Article XIII C of the California Constitution, which guarantees the people's power of initiative to affect local taxes.

A new Section 2 provides that if the Commission on State Mandates determines the act contains costs mandated by the state, reimbursement to local agencies and school districts shall be made pursuant to Government Code Part 7 (commencing with Section 17500).

The state-mandated local program designation changed from 'no' to 'yes,' reflecting the new reimbursement obligation for county elections officials who would administer initiative tax measures.
