SB 402 California Senate · 2025-2026 Regular Session

Health care coverage: autism.

Summary
Existing law, the Knox-Keene Health Care Service Plan Act of 1975, provides for the licensure and regulation of health care service plans by the Department of Managed Health Care and makes a willful violation of the act a crime. Existing law also provides for the regulation of health insurers by the Department of Insurance. Existing law requires a health care service plan contract or a health insurance policy to provide coverage for behavioral health treatment for pervasive developmental disorder or autism and defines "behavioral health treatment" to mean specified services and treatment programs, including treatment provided pursuant to a treatment plan that is prescribed by a qualified autism service provider and administered either by a qualified autism service provider or by a qualified autism service professional or qualified autism service paraprofessional. Existing law defines "qualified autism service provider," "qualified autism service professional," and "qualified autism service paraprofessional" for those purposes. Those definitions are contained in the Health and Safety Code and the Insurance Code. This bill would move those definitions to the Business and Professions Code. The bill would also make technical and conforming changes. This bill would incorporate additional changes to Section 1367.27 of the Health and Safety Code and Section 10133.15 of the Insurance Code proposed by AB 280 to be operative only if this bill and AB 280 are enacted and this bill is enacted last. This bill would incorporate additional changes to Section 1374.73 of the Health and Safety Code and Section 10144.51 of the Insurance Code proposed by AB 951 to be operative only if this bill and AB 951 are enacted and this bill is enacted last. This bill would incorporate additional changes to Section 11165.7 of the Penal Code proposed by AB 653 and SB 848, to be operative only if this bill and either or both of those bills are enacted and this bill is enacted last.

MODERATE
The diff shows the entire chaptered/enacted version of SB 402 (Chapter 413, approved October 6, 2025) being removed and replaced with a different version of the bill. The diff is truncated before any added lines are visible, so the full content of the replacement version cannot be assessed. The removed text includes the official chaptered formatting, the legislative counsel's digest, and the full statutory text covering telehealth definitions, new autism service provider definitions in the Business and Professions Code, and extensive provider directory requirements.
Scope change
Cannot be determined from the visible portion of the diff. The removed text shows the bill applied to health care service plans (regulated by the Department of Managed Health Care) and moved autism-related definitions from the Health and Safety Code and Insurance Code into the Business and Professions Code, but without seeing the added lines, it is unclear whether the replacement version changes scope.
TECHNICAL

Official chaptered formatting removed: 'STATE OF CALIFORNIA AUTHENTICATED ELECTRONIC LEGAL MATERIAL' header, Chapter 413 designation, governor approval date, and legislative counsel's digest.

A conditional Section 3.5 amending Section 1367.27 is removed. This section incorporated additional changes proposed by AB 280 (operative only if both bills are enacted and SB 402 is enacted last), adding requirements for displaying update dates, behavioral health access disclosures, population served information, cost-sharing tier identification, and central utility provisions for directory accuracy.

DEFINITION

Section 2290.5 of the Business and Professions Code (telehealth definitions and consent requirements) is removed from this version, including the definition of 'health care provider' that references qualified autism service providers under new Sections 4999.200 and 4999.201.

New Chapter 17 (Sections 4999.200-4999.202) of the Business and Professions Code defining 'qualified autism service provider,' 'qualified autism service professional,' and 'qualified autism service paraprofessional' is removed from this version.

REQUIREMENT

Section 1367.27 of the Health and Safety Code (provider directory requirements for health care service plans) is removed, including detailed rules on online/printed directories, update frequencies, accuracy verification, payment delay provisions, and enrollee protections for inaccurate directory information.
