What changed between versions
Section 40405 (BACT definition): Changed from allowing an emissions limitation to require 'a different type of fuel, including a requirement to use electric power' to specifically requiring only 'electric power to power a process or source.' This narrows what regulators can mandate as a fuel switch under BACT determinations.
Section 39013.5 (Alternative technology definition): Removed the phrase 'from power sector generation' before 'associated with the use of electricity from the grid,' broadening the scope of upstream emissions that cannot be used to exclude a technology from the alternative technology definition.
Section 40920.8(a)(1): Removed the requirement that the statewide clearinghouse identify relevant CDR (carbon dioxide removal) technologies as defined in Section 39741.
Section 40920.8(a)(3): Previously required publishing information on both next generation technologies AND carbon management technologies capable of reducing or removing greenhouse gases. Now only requires publishing information on next generation technologies for criteria air pollutant or toxic air contaminant emission reductions, removing the greenhouse gas/carbon management component.
Section 42301(c): Added clarifying language stating that the subdivision is not intended to provide any authority to the EPA to object to permit issuance other than that authority expressly granted by Title V of the Clean Air Act.
Corrected a duplicate 'SECTION 1' numbering error in the original bill and renumbered subsequent sections accordingly. Also fixed a typo ('next next generation' changed to 'next generation').
