Removed new Section 1374.54 of the Health and Safety Code, which prohibited health care service plans from seeking reimbursement for maternity services or newborn/pediatric care because an enrollee was acting as a gestational carrier, and prohibited denying coverage or discriminating based on circumstances of conception.

Removed new Section 10119.4 of the Insurance Code, which had parallel provisions prohibiting health insurers from seeking reimbursement for maternity services when an insured was acting as a gestational carrier, and from discriminating based on circumstances of conception.

The pregnancy triggering event in Section 1399.849(d)(1)(J) was simplified from 'The individual is pregnant. Enrollment shall not be affected by the circumstances of conception, including if the individual is acting as a gestational carrier, and shall be extended to individuals who are dependents of the pregnant individual and an individual to whom the pregnant individual is a dependent' to simply 'The individual is pregnant.' This removes explicit protection for gestational carriers and removes the language extending enrollment rights to dependents of the pregnant individual.

Removed the definition of 'maternity services' that had been included in the deleted Section 1374.54, which defined the term to include prenatal care, ambulatory care maternity services, involuntary complications of pregnancy, neonatal care, and inpatient hospital maternity care including labor and delivery and postpartum care.

The bill text was reformatted from the official enrolled document layout (with page numbers, signature blocks, and formal stamps) into a web-based bill tracking page format with navigation elements, bill status information, and version history.

In Section 1374.54 (Health and Safety Code), subdivision (a) was narrowed from prohibiting plans from 'deny[ing], limit[ing], or not seek[ing] reimbursement' for maternity services to only prohibiting plans from 'seek[ing] reimbursement' because the enrollee is acting as a gestational carrier.

Several specific prohibited actions were removed from both Section 1374.54 and Section 10119.4: increasing a premium, deductible, copayment, or coinsurance; penalizing or reducing reimbursement of an attending health care provider; and reducing coverage. These were consolidated into a general 'otherwise discriminate' provision.

The general anti-discrimination provision in both sections was expanded to explicitly name protected parties: an enrollee or insured, their newborn, and an attending health care provider, all protected from discrimination based on circumstances of conception.

Section 10119.4 (Insurance Code) was changed from applying to 'disability health insurance policy' to 'health insurance policy,' broadening the range of policies subject to the gestational carrier anti-discrimination requirements.

The six prohibited actions in both the health care service plan section (Sec. 2) and the disability insurance section (Sec. 4) were restructured. Originally, all six actions were listed as direct prohibitions 'based on the circumstances of conception.' Now only item (1) - denying, limiting, or not seeking reimbursement for maternity services because someone is a gestational carrier - is the core prohibition under subdivision (a). The remaining items (deny coverage, increase premiums, penalize providers, reduce coverage, otherwise discriminate) are moved to a new subdivision (b) framed as compliance measures: 'To comply with subdivision (a), a plan shall not do either of the following based on the circumstances of conception.' This narrows the bill's direct enforcement focus to gestational carrier-specific reimbursement denials.

In both Section 2 and Section 4, item (1) was changed from 'Deny, limit, or seek reimbursement' to 'Deny, limit, or not seek reimbursement.' The original phrasing was grammatically ambiguous and could be misread as prohibiting plans from seeking reimbursement. The amendment clarifies that plans cannot fail to seek reimbursement for maternity services provided to gestational carriers.

Three new coauthors were added: Senators Limon, Rubio, and Wiener, in addition to the original coauthors Ashby, Cabaldon, Cervantes, and Laird.

Section 4 (Insurance Code) changed 'disability insurance policy' to 'disability health insurance policy,' potentially narrowing the category of policies covered by the new prohibition.
