Low-carbon fuel standard: regulations.
Summary
The California Global Warming Solutions Act of 2006 establishes the State Air Resources Board as the state agency responsible for monitoring and regulating sources emitting greenhouse gases. The act requires the state board to adopt rules and regulations to achieve the maximum technologically feasible and cost-effective greenhouse gas emissions reductions to ensure that the statewide greenhouse gas emissions are reduced to at least 40% below the statewide greenhouse gas emissions limit, as defined, no later than December 31, 2030. Pursuant to the act, the state board has adopted the Low-Carbon Fuel Standard regulations. This bill would void specified amendments to the Low-Carbon Fuel Standard regulations adopted by the state board on November 8, 2024, or as subsequently adopted, as specified. This bill would declare that it is to take effect immediately as an urgency statute.

MINOR
The Senate amendment broadens the scope of SB 2 in two important ways. First, it expands the list of voided regulatory sections to include newly adopted sections (95486.3, 95486.4, and 95491.2) and Section 95480, which were not covered in the original version. Second, and most significantly, it adds language ensuring that if the State Air Resources Board rewrites and re-adopts the regulation in response to the Office of Administrative Law's disapproval (OAL Matter 2025-0103-01), the voiding still applies. This closes a potential loophole where CARB could simply reissue the rule after minor revisions.
SCOPE
The list of voided regulatory sections was expanded to include newly adopted Sections 95486.3, 95486.4, and 95491.2, as well as Section 95480, which were not in the original introduced version.
Added a provision that the voiding applies even if CARB subsequently rewrites and re-adopts the final regulation order in response to the Office of Administrative Law's Notice of Disapproval (OAL Matter Number 2025-0103-01). This prevents CARB from circumventing the bill by simply reissuing the regulation with modifications.
