Criminal procedure: protective orders.

The minimum duration of protective orders for defendants convicted of registerable sex offenses involving minor victims was changed from an unspecified floor (up to 20 years) to a mandatory minimum of the later of 10 years or until the minor victim reaches 18 years of age. This means a 5-year-old victim would be protected for at least 13 years, and in all cases the order must last at least 10 years.

The maximum duration of a protective order for a defendant convicted of a registerable sex offense involving a minor victim was reduced from 25 years to 20 years.

A new operative date of July 1, 2027 was added for subdivision (j) of Section 136.2, meaning the expanded protective order provisions for sex offenses involving minor victims will not take effect until that date.

The court may now consider issuing an order restraining the defendant from any person who is a member of the victim's family or household, expanding protection beyond just the direct victim.

The fiscal note was reorganized: the state-mandated local program paragraph was moved to after the reimbursement discussion, and a typo ('Judicial Council Council') was corrected to 'Judicial Council.'

A specific deadline of July 1, 2027 was added for the Judicial Council to develop forms, instructions, and rules relating to the protective orders created by this bill.

The language in subdivision (j)(1) was simplified: the April version stated the court would act 'in the discretion of the court and unless the victim otherwise requests' and explicitly allowed victims to petition for an order. The May version removes these qualifiers, stating simply that the court 'shall also consider issuing an order restraining the defendant from contact with the victim.'

Added a new protective order option in Section 136.2(j)(1) allowing courts to issue an order restraining a defendant convicted of a registerable sex offense involving a minor victim from contact with the victim for up to 25 years, as determined by the court based on seriousness of facts, probability of future violations, and safety of the victim and immediate family.

The scope of protective orders available to courts for sex offenders against minors expanded from an all-or-nothing choice (lifetime or none) to a graduated option that includes a 25-year maximum duration, providing courts with more flexibility in tailoring restrictions to the specific circumstances of each case.
