Solid waste handling services: labor dispute.

Section 53064.3(b) no longer explicitly states that force majeure provisions are void 'regardless of the date on which the contract, license, or permit was entered into.' The old language made clear the prohibition applied retroactively to all existing solid waste handling contracts. The enrolled version simply says such provisions are 'void and unenforceable to the extent that it excuses or suspends performance due to a work stoppage arising out of or in connection with a labor dispute,' without the explicit all-dates language. This narrows or creates ambiguity about whether pre-existing contracts (entered into before January 1, 2027) are still covered by subsection (b).

Removed the prohibition on local agencies issuing and employers requesting, inducing, relying upon, or causing to be issued sanitation, health, or safety orders to compel work during a lawful labor dispute involving solid waste handling services (former subdivision (c)).

Removed the detailed conditions under which a sanitation, health, or safety order could require performance of services during a labor dispute, including requirements for independent agency action, written findings of imminent threat, limited scope and duration, and contemporaneous notice to the exclusive bargaining representative (former subdivision (d)).

Renumbered the definitions subdivision from (e) to (c) following the removal of subdivisions (c) and (d). The definitions for 'solid waste handling services,' 'substantially amended,' and 'labor dispute' are substantively unchanged.

Subdivision (b) now includes 'to the extent that it excuses or suspends performance due to a work stoppage arising out of or in connection with a labor dispute,' narrowing the void provision so it only invalidates the labor-dispute-related portion of a force majeure clause rather than the entire clause. As drafted, however, the amendment contains duplicated language that appears to be a clerical error.
