Juvenile court: procedure.

Section 782(g) changed from 'a person shall not suffer any future adverse consequences in the future' to 'a person shall not suffer any adverse consequences in the future,' removing a redundant word. This is a drafting cleanup with no change in legal effect.

Section 1 now codifies People v. Haro (2013) in addition to In re David T. (2017), and explicitly disapproves the holdings of In re Taylor C. (2024) and In re Parker B. (2026), narrowing the legal landscape for juvenile dismissal cases.

New Section 1(c) clarifies that dismissal under Section 782 and sealing of records are 'related yet distinct procedures,' and states the Legislature did not intend to reduce the relief afforded by a Section 782 dismissal or alter established law holding that such a dismissal removes restrictions on sealing contained in sealing statutes.

New Section 1(b) reaffirms that a Section 782 dismissal means the petition is 'effectively erased as if the subject had never suffered it in the initial instance,' strengthening the legal effect of dismissal beyond what was previously stated.

New subdivision (h) to Section 782 provides that a dismissal of a sustained petition is deemed to constitute both a dismissal of the petition and a setting aside of any findings, eliminating ambiguity about what a dismissal encompasses when the petition was previously sustained.

Section 782(g) adds the redundant phrase 'in the future' before 'based on an adjudication dismissed,' which does not change substantive meaning but is a drafting artifact.

Section 1 intent statement was reworded from 'It is the intent of the Legislature in enacting this act to codify' to 'The intent of the Legislature in enacting this act is to codify.' No change in meaning.
