Vehicles: driving under the influence.

The bill text was reformatted from a traditional legislative document layout (with line numbers, page breaks, and column formatting) to a web-based presentation format that includes website navigation elements (home, search, FAQ, etc.) and a different visual structure. The actual statutory language of Section 1656.25 is identical in both versions.

All Business and Professions Code provisions were removed. Section 25655 (requiring alcohol sellers to demand and verify proof of age and identity, with a $1,000 fine and 24 hours community service for violations) and Section 25657.5 (making it a misdemeanor to sell alcohol to someone whose ID bore the 'NO ALCOHOL SALES' designation) were both eliminated.

Section 13353.9 of the Vehicle Code was removed. This section had required DMV to issue an identification card or driver's license with a 'NO ALCOHOL SALES' designation and a digital point-of-sale indicator for individuals subject to an alcohol purchase prohibition.

New Section 1656.25 of the Vehicle Code requires DMV, upon legislative appropriation, to include a summary of DUI penalties with each motor vehicle registration, registration renewal, transfer of registration, driver's license, and license renewal. The summary must cover criminal penalties, administrative consequences (including license suspension and alcohol purchase prohibition), financial consequences, public safety risks, and annual updates to DUI-related statutes.

For digital registration systems, the summary information must be displayed prominently as a pop-up window before user interaction and on the redirected website page. The Legislature expressed intent to maintain educational provisions of physical materials once the digital system is available.

State-mandated local program designation changed from 'yes' to 'no' because the new crimes were removed. The entire reimbursement section (formerly Section 5) was deleted since no state-mandated local program costs remain.

Entire Section 23590 was deleted. This section would have required courts, upon conviction for certain DUI offenses with prior convictions within 10 years, to issue an order prohibiting the person from purchasing alcohol for 3 to 10 years. It also required courts to consider offense severity, prior DUI history, and other aggravating or mitigating factors, and allowed non-alcohol DUI convictions to serve as a basis only if the court identified a factual justification.

A new exemption was added to Section 1656.25(a) stating that the requirement to include the penalty summary does not apply to applications processed by a registration service (as defined in Section 505.2) or a private industry partner contracted with the DMV under Section 1685.

In Section 1656.25(c), the phrase 'the redirected internet website page' was changed to 'any redirected internet website page,' broadening the digital display requirement slightly to cover all redirected pages rather than a specific one.

The bill's scope expanded from a single nonsubstantive fix to Section 900 of the Streets and Highways Code to also add four new code sections across the Business and Professions Code and Vehicle Code, creating an entire alcohol purchase prohibition framework for repeat DUI offenders.

Senator Archuleta was added as a coauthor of the bill in the amended version.

New Vehicle Code Section 23590 requires courts to issue an order prohibiting a person from purchasing alcohol for 3 to 10 years upon conviction for certain DUI offenses (Sections 23152, 23103 as specified in 23103.5, 23153, or Penal Code 191.5) when the offense occurs within 10 years of a prior separate conviction for the same offenses, or when the person has two prior separate convictions (or any combination thereof). The court must consider severity of offenses, prior DUI history, and other relevant aggravating or mitigating factors.

New Vehicle Code Section 13353.9 requires the DMV to issue an identification card or driver's license bearing the words 'NO ALCOHOL SALES' (or another appropriate designation) on its face, plus a digital point-of-sale indicator, for any individual with a court order under Section 23590. The designation may only be used for commercial alcohol sales purposes.

New Business and Professions Code Section 25655 requires every person who sells or causes to be sold any alcoholic beverage to demand and review bona fide evidence of majority and identity from the purchaser. A violation is a misdemeanor punishable by a $1,000 fine (no part suspendable) and at least 24 hours of community service during non-working, non-school hours.

New Business and Professions Code Section 25657.5 makes it a misdemeanor to sell or cause to be sold any alcoholic beverage to a person who presents an ID or driver's license issued under the new 'NO ALCOHOL SALES' provision. A defense exists if the seller, employee, or agent demanded and acted in reliance on bona fide evidence of majority and identity. The section does not apply to unknowing furnishing of alcohol by private individuals.

A conviction for a DUI that does not involve alcohol may not serve as the basis for an alcohol purchase prohibition order unless the court identifies a factual basis explaining why the order would be appropriate, creating a carve-out for drug-only DUI convictions.

The fiscal committee designation changed from 'no' to 'yes,' and the state-mandated local program designation changed from 'no' to 'yes,' reflecting that the new criminal provisions impose costs on local agencies. A reimbursement provision was added stating no reimbursement is required for creating new crimes, but if the Commission on State Mandates identifies other mandated costs, reimbursement shall be made under Government Code Part 7.
