Preventive Treatment Health Care Act.

The GLP-1 antiobesity medication partnership authorization was moved from subsection (a)(2) (general emerging health concerns) to its own standalone subsection (b). This makes it a separate, distinct mandate rather than one example within a broader category, giving it greater legislative prominence and clarity.

Redundant language in the general 'emerging health concerns' provision was cleaned up: 'gender affirming care and gender-affirming health care' was simplified to just 'gender-affirming health care.'

Standard enrolled bill elements were added: Senate passage date (August 27, 2026), Assembly passage date (August 24, 2026), Governor's receipt line, and approval signature block.

All amendment markup was removed, including line numbers, previous amendment dates in the header, and the 'as amended' reference in the digest.

Removed references to 'most favored nation pricing' and federal Executive Order No. 14297 (May 12, 2025) from both the public employee health plan cost provision (Gov Code 22853.5(b)) and the CHHSA partnership negotiation provision (H&S Code 127697(b)). The pricing benchmark is now simply 'the cost to Medi-Cal beneficiaries in the year 2025 or better pricing.'

Removed redundant language 'management, management' in Gov Code 22853.5(a), changing it to 'chronic weight disease management or to treat obesity or overweight persons' for clarity.

Section renumbering: what was previously Section 4 (amending H&S Code 127697) is renumbered to Section 3 in the new version, though the markup shows some inconsistency with a standalone 'SEC. 4.' line remaining.

Assembly Member Caloza added as coauthor, indicating the Assembly took up and amended the bill after its Senate passage.

The entire amendment to Section 127693 of the Health and Safety Code was deleted. The previous version required CHHSA partnerships to include acquisition or production of specific named drugs (semaglutide, GLP-1RA, GIP+GLP-1 tirzepatide, and future chronic weight disease products) at production and dispensing costs. This mandatory requirement is gone.

The bill now only amends Section 127697, which authorizes (rather than requires) CHHSA to enter into partnerships for 'at least one GLP-1 antiobesity medication approved by the FDA.' This is a permissive authorization subject to legislative appropriation, not a mandate.

The legislative findings were simplified. The previous version described the act's intent as increasing workforce access to identify, counsel, and treat chronic weight disease with specific drug products available at Medi-Cal 2025 price or better. The new version simply states the act is 'intended to promote access to affordable GLP-1 weight management medication for Californians.'

The effective date for public employee health plan coverage of chronic weight disease management was changed from January 1, 2027 to January 1, 2028. The sunset date remains January 1, 2032.

Coverage language changed from requiring plans to offer 'optional coverage... as part of one of its health plan options' to simply requiring plans to 'offer coverage for chronic weight disease management.' This removes the optional framing and makes it a standard plan component rather than an add-on option.

The previous version required CHHSA to make chronic weight disease management medications available to state and local government employers and to determine whether they should be made available to all Californians. This requirement was entirely removed.

Pricing requirements were weakened. The previous version mandated that covered treatments be offered 'at the cost previously provided to Medi-Cal beneficiaries in the year 2025 or the most favored nation pricing... or better pricing.' The new version states these costs 'may be considered,' making them advisory rather than binding.

The definition of 'GLP-1 antiobesity medication approved by the FDA' was expanded to include 'GLP-1 receptor dual agonist' as a qualifying drug class, in addition to GLP-1, GLP-1 receptor agonist, GIP+GLP-1, and tirzepatide.

Section 1374.6 of the Health and Safety Code was removed entirely. This section had required large group health care service plan contracts issued, amended, or renewed on or after January 1, 2027 to cover weight loss as a medical condition and include at least one FDA-approved antiobesity medication.

Section 10123.62 of the Insurance Code was removed entirely. This section had required large group health insurance policies issued, amended, or renewed on or after January 1, 2027 to cover weight loss as a medical condition.

Section 2805 of the Labor Code was removed entirely. This section had required employers with 100 or more employees to offer their employees access to exercise programs or gym memberships, nutrition services, and coverage for a GLP-1 or GLP-1 receptor agonist.

Section 130514 of the Health and Safety Code was removed entirely. This section had authorized employers with 100 or more employees to negotiate directly with drug manufacturers for GLP-1 or GLP-1RA discounts.

New Section 127697 of the Health and Safety Code authorizes CHHSA, subject to legislative appropriation, to enter into partnerships to increase competition, lower prices, and address supply shortages for: over-the-counter naloxone products; generic or brand name drugs addressing emerging health concerns (including reproductive health, gender affirming care, and GLP-1 antiobesity medications); vaccines; and medical supplies or devices.

The effective date for public employee health benefit plans to offer optional chronic weight disease management coverage was changed from January 1, 2027 to January 1, 2028 in Section 22853.5 of the Government Code.

Section 22853.5 now includes a definition clarifying that a 'glucagon-like peptide-1 (GLP-1) antiobesity medication approved by the United States Food and Drug Administration' includes a GLP-1, GLP-1 receptor agonist, glucose-dependent insulinotropic polypeptide plus GLP-1, or tirzepatide.

In Section 127693, the separate requirement that partnerships include 'the production of at least one glucagon-like peptide-1 (GLP-1) or GLP-1 receptor agonist (GLP-1RA)' as a standalone paragraph was consolidated into the existing language already covering GLP-1 semaglutide, GLP-1RA, GIP+GLP-1 tirzepatide, and future chronic weight disease products.

In Section 127693, the state brand provision changed from 'biosimilar insulin' to simply 'insulin,' broadening the scope of what can be branded under the state brand.

New Government Code Section 22853.5 requires public employee health benefit plans (through PERS) to offer optional coverage for chronic weight disease management, including nutritional information and GLP-1 semaglutide, GLP-1RA, GIP+GLP-1 tirzepatide, and future chronic weight disease products, as part of one of its plan options. CHHSA partnership authority expanded from generic drug production/procurement/distribution only to also include acquisition of brand name prescription drugs. The partnerships must now include both insulin production AND acquisition or production of pens, vial injections, pills, and patches of GLP-1 semaglutide, GLP-1RA, GIP+GLP-1 tirzepatide, and future chronic weight disease products.

New pricing requirement: covered chronic weight disease management must be offered at the cost previously provided to Medi-Cal beneficiaries in 2025, or the most favored nation pricing set forth in federal Executive Order No. 14297 (May 12, 2025), or better pricing.
