A resolution to propose to the people of the State of California an amendment to the Constitution of the State, by amending Sections 1, 3, and 6 of, and by repealing Section 2 of, Article XII thereof, relating to public utilities.

Removed the requirement that the Assembly approve all PUC commissioners. The Assembly version required 'approved by the Senate and the Assembly, a majority of the membership of each house concurring.' The Senate version only requires Senate approval for the five Governor-appointed members.

Section 1(a) no longer describes the appointment or approval process in its general language. It now simply states the commission 'consists of nine members serving staggered six-year terms.' The specific appointment and approval mechanics are moved entirely to subdivision (b)(1).

The amendment structure was reorganized. The Assembly version had a separate 'First' amendment that restated Section 1 with the old 5-member structure before the 'Second' replaced it. The Senate version consolidates this into a single 'Second' amendment to Section 1, with the intent provisions (recodifying Section 2 as statute, preserving Legislature's authority over telephone/broadband classification, and establishing a broadband entity by January 1, 2028) moved to a new 'First' section.

The digest was updated to remove the sentence stating the measure would require Assembly approval of each member, reflecting the substantive change above.

Commission membership increased from 5 to 9 members. Five are appointed by the Governor (as before), two by the Senate Committee on Rules, and two by the Speaker of the Assembly. All still require Senate approval by majority.

Section 2 of Article XII (which allowed the commission to establish its own procedures) is now fully repealed rather than partially amended. The Legislature states its intent to recodify that provision as a statutory provision in the Public Utilities Code in a separate measure.

A clarifying intent statement is added confirming that amending Section 3 does not limit the Legislature's authority to prescribe additional classes of public utilities, including those involved in telephone and telegraph message transmission.

A new mandate requires the establishment of a state entity, separate from the PUC, on or before January 1, 2028, dedicated to promoting ubiquitous broadband infrastructure deployment, increasing broadband adoption, and promoting a competitive broadband market.

The definition of public utilities in Section 3 still removes telephone and telegraph message transmission, but a new subdivision (b) is added explicitly authorizing the Legislature to prescribe PUC duties relating to telephone corporations, telecommunications service, and broadband service, including reassigning those duties to another state entity.

Transition provisions are added: existing commissioners remain in office until their terms expire or they resign or are removed, and replacement commissioners must be appointed by the same authority that appointed the departing member.
