What changed between versions
New Section 1(b) adds a legislative finding that data center growth has created increasing demand for water and energy resources with implications for statewide sustainability goals, and that DWR has the technical expertise to develop efficiency standards balancing operational reliability with conservation.
New Section 1(c) adds an intent statement encouraging DWR to examine potential efficiency measures for data centers in consultation with stakeholders, including water use efficiency, energy demand management, and integration of emerging technologies.
The definition of 'data center' was narrowed. The old version defined it broadly as 'a facility that houses computing infrastructure, including graphics and central processing units, servers, storage devices, networking equipment, and associated power and cooling systems.' The new version defines it only as 'a room, or portion of a room, in a building used primarily to house information technology equipment that serves a total information technology equipment load greater than 10 kilowatts and 20 watts per square foot of conditioned floor area.'
All three statutory data center tier definitions were removed: Type I (hyperscale, more than 10,000 kg/sq m, more than 10,000 servers, more than 25 MW), Type II (2,000-50,000 kg/sq m, 2-25 MW), and Type III (500-5,000 kg/sq m, less than 2 MW). DWR retains authority under Section 4 to identify tiers when adopting efficiency standards, but they are no longer defined in statute.
