AB 783 California Assembly · 2025-2026 Regular Session

Public contracts: construction materials: disaster relief.

Summary
Existing law authorizes the Department of General Services to enter into contracts on a bid or negotiated basis with manufacturers and suppliers of single source or multisource drugs, and to obtain from them discounts, rebates, or refunds as permissible under federal law. This bill would, until January 1, 2031, authorize the department to negotiate and enter into contracts on a bid or negotiated basis for construction materials commonly used in residential structures that may include price discounts, rebates, refunds, or other strategies aimed at lowering the cost of these materials. The bill would require that these materials be offered at cost or with minimal administrative fees added to homeowners, contractors, nonprofit organizations, and local governments in any area affected by a state of emergency resulting from an earthquake, flood, fire, storm, or other natural disaster, as specified. The bill would require that the materials only be used for recovery efforts that are directly linked to housing losses caused by a state of emergency. This bill would prohibit its provisions from being interpreted to require the department to store or distribute materials. The bill would also require the department to report annually to specified committees of the Legislature on the implementation, cost savings, and effectiveness of these provisions.

MINOR
The May 1 amendment adds a new section (14983.4) explicitly stating that nothing in the chapter requires the Department of General Services to store or distribute materials, significantly limiting the department's obligations under the bill. It also narrows the annual reporting requirement from a general report to the Legislature to specific reports to the Assembly Committee on Emergency Management and the Senate Committee on Governmental Organization, and appears to reduce the required report contents from three items to two (though the amendment contains drafting errors in the numbering).
Scope change
The bill's practical scope was narrowed: while it still authorizes bulk procurement contracts for disaster construction materials, the new explicit exemption from storage and distribution obligations means the department could theoretically enter contracts without being required to actually get materials to affected communities. The reporting obligation was also narrowed in both audience (specific committees) and content (fewer required data points).
SCOPE

New Section 14983.4 explicitly states that nothing in the chapter shall be interpreted to require the department to store or distribute materials. This is a major limitation: the bill authorizes bulk procurement contracts but does not obligate the department to handle physical logistics of getting materials to disaster areas.

ENFORCEMENT

The annual transparency report now must be submitted specifically to the Assembly Committee on Emergency Management and the Senate Committee on Governmental Organization, rather than to the Legislature generally. This gives two specific committees oversight responsibility.

REQUIREMENT

The required report contents appear to have been reduced from three items (quantities purchased, distribution metrics, rebuilding outcomes) to two items, though the amendment contains a drafting error with a blank line 3 and duplicate numbering. The language 'all both of the following' is grammatically incorrect, suggesting a sloppy edit that removed one reporting requirement.
