AB 773 California Assembly · 2025-2026 Regular Session

Marine resources: copper-based antifouling paint: standards, studies, and best methods.

Summary
Existing law, the California Ocean Resources Stewardship Act of 2000, finds that it is the policy of the state to, among other things, ensure adequate coordination of ocean resources management science among state, regional, and federal agencies and marine science institutions, as provided. This bill would require, on or before January 1, 2028, the Department of Pesticide Regulation to complete a reevaluation of copper-based antifouling boat paint products, and to make the determination to retain, modify, or suspend its standards or to place new appropriate standards on the chemical composition or use of copper-based antifouling paints. The bill would require, on or before June 1, 2027, the California Environmental Protection Agency, the State Water Resources Control Board, regional water control boards, and the Department of Pesticide Regulation to collaborate on active studies related to the effectiveness of low-leach-rate paint and elevated copper concentrations in saltwater harbors, bays, and marinas that are primarily a result of the use of copper-based antifouling paint, and would require the Department of Pesticide Regulation to finish and release these studies. The bill would require, on or before January 1, 2028, the California Environmental Protection Agency, the State Resources Control Board, and the Department of Pesticide Regulation to collaborate to determine the best methods to address elevated copper concentrations in saltwater harbors, bays, and marinas that are primarily a result of the use of this paint in the state. The bill would require, on or before January 1, 2028, the California Environmental Protection Agency to post on its internet website these best methods.

MODERATE
The amended version of AB 773 adds specific deadlines, broadens the scope of required studies, introduces a new Department of Pesticide Regulation reevaluation requirement, adds CalEPA as a required collaborator, and shifts the focus from regulating paint use to addressing existing elevated copper concentrations in harbors, bays, and marinas. It also requires CalEPA to publicly post the resulting best methods on its website by January 1, 2028.
Scope change
The bill's scope broadens from a narrow focus on suspending enforcement pending studies of low-leach-rate paint effectiveness to a more comprehensive framework that includes reevaluation of existing standards, investigation of actual copper contamination in specific water bodies, remediation-focused best methods, and public transparency through website posting. CalEPA is newly brought into the process as a coordinating agency.
REQUIREMENT

New requirement for the Department of Pesticide Regulation to complete a reevaluation of copper-based antifouling boat paint products by January 1, 2028, and determine whether to retain, modify, or suspend its standards or place new standards on chemical composition or use.

The 'best methods' requirement is refocused from determining how to regulate the use of copper-based antifouling paint to determining how to address elevated copper concentrations in saltwater harbors, bays, and marinas.

SCOPE

The required studies are expanded from focusing solely on the effectiveness of low-leach-rate paint to also covering elevated copper concentrations in saltwater harbors, bays, and marinas primarily resulting from copper-based antifouling paint use.

The California Environmental Protection Agency is added as a required collaborator on both the studies and the best methods determination, which were previously limited to the State Water Resources Control Board, regional water boards, and DPR.

TIMELINE

Specific deadlines added: June 1, 2027 for completion and release of studies; January 1, 2028 for the DPR reevaluation, best methods determination, and CalEPA website posting.

ENFORCEMENT

New requirement for CalEPA to post the best methods on its internet website by January 1, 2028, which may include compliance guidelines and public workshops.
