AB 740 California Assembly · 2025-2026 Regular Session

Virtual power plants: load shifting: integrated energy policy report.

Summary
Existing law requires the State Energy Resources Conservation and Development Commission (Energy Commission) , in consultation with specified entities, to adopt a biennial integrated energy policy report containing certain information, including an overview of major energy trends and issues facing the state. This bill would require the Energy Commission, in the next update to the biennial integrated energy policy report after January 1, 2027, and subject to available funding, to adopt a virtual power plant deployment plan. The bill would require the Energy Commission, in developing the plan, to take certain actions, and would require that the plan meet specified requirements. Existing law requires the Energy Commission, in consultation with the Public Utilities Commission and the Independent System Operator, to adopt a goal for load shifting to reduce net peak electrical demand and adjust this target in each biennial integrated energy policy report thereafter. This bill would require each electrical corporation to annually report to the Energy Commission its contribution towards meeting that load-shift goal.

MINOR
The enrolled version of AB 740 makes one substantive policy change: it removes the fixed deadline of November 1, 2026 for adopting a virtual power plant deployment plan and instead ties adoption to the next biennial integrated energy policy report update after January 1, 2027. It also drops the requirement that the plan be adopted at a publicly noticed voting meeting and removes an explicit provision requiring the plan to be included in the Section 25302 report (now implied by the timing language). All other changes are standard enrollment formatting.
TIMELINE

The deadline for the Energy Commission to adopt a virtual power plant deployment plan changed from 'on or before November 1, 2026' to 'in the next update to the biennial integrated energy policy report after January 1, 2027,' effectively pushing the deadline later and tying it to the existing biennial reporting cycle.

REQUIREMENT

Removed the requirement that the plan be adopted at a publicly noticed voting meeting.

Removed explicit subsection (d) requiring the deployment plan to be included in the report prepared under Section 25302. This is now implied by the timing language that ties adoption to the biennial report update.
