Electrical corporations: resiliency planning: microgrid projects.

Removed the requirement for the PUC to mandate optional dynamic pricing tariffs (CalFUSE-based) for all electrical corporations by January 1, 2028 (former Section 469).

Added legislative findings that the microgrid collaboration provisions address a matter of statewide concern rather than a municipal affair, making them applicable to all cities including charter cities.

The AMI requirements (Sections 9530-9531) were retained but narrowed to apply only to local publicly owned electric utilities; the parallel requirements for electrical corporations were removed entirely.

Removed the requirement for electrical corporations to analyze AMI feasibility by January 1, 2028 and develop a complete AMI deployment plan by January 1, 2029 (former Chapter 10.3, Sections 8430-8431).

Added Section 8373 requiring large electrical corporations to collaborate with local governments, tribal governments, and community choice aggregators to identify critical circuits and microgrid projects upon request.

Added a data sharing mandate requiring large electrical corporations to provide distribution equipment data, transmission and distribution circuit data, grid hardening plans, and other requested information within 30 days of receipt of a request.

Added extensive definitions in Section 8370 including: critical circuit, critical customer, critical facilities and critical infrastructure, deenergization event, distributed energy resource, high fire-threat district, large electrical corporation (more than 100,000 service connections), microgrid, project, and resiliency.

Added confidentiality protections requiring that customer personal information and locations be provided on a confidential basis and used only for microgrid planning, with recipients obligated to maintain confidentiality of information designated as confidential by the electrical corporation.

Entire Part 3 (Sections 9530-9531) requiring local publicly owned electric utilities to analyze AMI feasibility by January 1, 2028 and develop a deployment plan by January 1, 2029 was deleted. The bill no longer imposes any obligations on local publicly owned electric utilities.

Section 8373(a) changed from 'A large electrical corporation shall, upon request, collaborate with...' to 'The commission shall require large electrical corporations to collaborate with...,' shifting the trigger from a direct statutory duty to one where the PUC directs the requirement.

Section 8373(a) now includes 'support resiliency planning, including identifying critical facilities that may be vulnerable to repeated deenergization events' as part of the collaboration obligation.

Section 8373(b)(1) changed from requiring utilities to 'provide... electrical distribution equipment data' to providing 'access to data, including electrical distribution equipment data... and other information requested as directed by the commission,' with a new qualifier that access must be 'consistent with privacy, customer consent, confidentiality, and electrical grid security laws.'

New subsection (b)(2) authorizes the commission to require large electrical corporations to share information in aggregated and anonymized form to protect customer privacy and electrical grid security.

The fixed 30-day response deadline for data requests was removed and replaced with 'within the timelines determined by the commission,' giving the PUC discretion over response timing rather than a statutory deadline.

The entire Penal Code Section 490.45 creating criminal penalties for gift card theft, forgery, and fraud was deleted from the bill. This removed misdemeanor and felony provisions covering unauthorized acquisition, alteration, use, and scheme-based theft of gift cards and redemption information.

The advanced metering infrastructure requirements for local publicly owned electric utilities were moved from Chapter 10.3 in Division 4.1 to a new Part 3 (Section 9530) in Division 4.8 of the Public Utilities Code, separating them structurally from the electrical corporation provisions.

A new data privacy provision was added prohibiting local publicly owned electric utilities from sharing, disclosing, making accessible to third parties, or selling customer electrical usage data collected through advanced metering infrastructure, with specified exceptions. Customers must also have the option to access their data without agreeing to share personally identifiable information with third parties.

A second no-reimbursement section was added (SEC. 2) specifically for the new Division 4.8 Part 3 provisions, stating no state reimbursement is required because local agencies can levy service charges, fees, or assessments to cover mandated costs.

The bill now covers electricity regulation in addition to gift card theft, adding Public Utilities Code Section 469 and Chapter 10.3 (Sections 8430-8431) to Division 4.1.

Requires the CPUC to mandate that each electrical corporation offer optional dynamic pricing tariffs by January 1, 2028, consistent with Energy Commission load management standards and the CalFUSE hourly dynamic pricing framework.

Requires both electrical corporations and governing boards of local publicly owned electric utilities to analyze the feasibility of deploying advanced metering infrastructure (AMI) to all customers by January 1, 2028.

Requires both electrical corporations and local publicly owned electric utility governing boards to develop a plan for complete AMI deployment, where feasible, by January 1, 2029.

Adds definitions of 'electrical corporation' (cross-referencing Section 218) and 'local publicly owned electric utility' (cross-referencing Section 224.3) in new Section 8430.

A new reimbursement provision was added for the electricity provisions, stating no state reimbursement is required because local agencies have authority to levy service charges, fees, or assessments sufficient to cover mandated costs, in addition to the existing crime-related exemption.

The sub-clause structure within the 'gift card' definition was reorganized: closed-loop and open-loop gift card definitions changed from labels (i) and (ii) to (i)(A) and (ii)(B), adding an extra level of lettered sub-clauses. The legal meaning of the definitions is unchanged.

Line numbers throughout Section 1 were renumbered to reflect the added sub-clause labels, and page numbers shifted from 99 to 98 due to the reformatting.
