Crimes: burglary tools.

A new subdivision explicitly provides that a person who organizes, facilitates, encourages, promotes, or instigates a sideshow may be charged with aiding or abetting under subdivisions (b) and (c) even if they are not physically present at the scene of the sideshow.

A savings clause was added stating that the new provision does not abrogate or modify the legal elements required to prove aiding and abetting as established in People v. Beeman (1984) 35 Cal. 3d 547, preserving existing common law requirements while clarifying the physical presence point.

The legislative counsel's digest was updated from 'as introduced' to 'as amended' and expanded to describe the new explicit charging provision for non-present organizers of sideshows.

Corrected a typographical error in Section 2: 'Article XIIIB' was changed to 'Article XIII B' (the proper citation format for Article XIII, Section B of the California Constitution).

New section amending Penal Code Section 466 adds key programming devices, key duplicating devices, and signal extenders to the list of instruments that constitute a misdemeanor when possessed with intent to feloniously break or enter a building or vehicle. This expands existing burglary tools law to cover modern electronic car-access devices.

The words 'encourages' and 'promotes' were removed from subdivision (m) of Vehicle Code Section 23109, which defines who can be charged with aiding or abetting a sideshow. The list now reads 'organizes, facilitates, or instigates' instead of 'organizes, facilitates, encourages, promotes, or instigates,' narrowing the range of conduct that triggers the non-presence aiding-and-abetting provision.

New definitions added for 'key programming device' or 'key duplicating device' (any device capable of accessing a vehicle's onboard computer to make additional keys, delete keys, or remotely start the vehicle) and 'signal extender' (a key fob amplifier or other device that extends the signal range of a keyless entry car fob).

A new no-reimbursement provision was added for the Penal Code 466 amendment, stating that no state reimbursement is required because the act creates a new crime or changes the definition of a crime under Government Code Section 17556.

All amendments to Vehicle Code Section 23109 were removed, including: enhanced penalties for sideshow-related speed contests (community service requirement, mandatory jail time for repeat offenders within five years, state prison option for serious bodily injury), the definition of 'sideshow' as a street takeover, the provision allowing organizers/facilitators to be charged with aiding and abetting even if not physically present at the scene, vehicle impoundment authority, license suspension/restriction provisions tied to sideshows, and the naming of the section as the Louis Friend Memorial Act.

The bill's stated purpose was narrowed from 'An act to amend Section 23109 of the Vehicle Code, relating to vehicles. An act to amend Section 466 of the Penal Code, relating to crimes' to only 'An act to amend Section 466 of the Penal Code, relating to crimes.'

The legislative counsel's digest was updated to remove all references to sideshows and street takeovers, now describing only the burglary tools expansion.

Removed a standalone definitional provision (former first subdivision (m)) that stated 'aid or abet' includes organizing, facilitating, encouraging, promoting, or instigating a violation as part of a sideshow, and that physical presence is not required. This definition is no longer separately codified.

Consolidated the two former subdivision (m) provisions into a single subdivision (m) that directly states a person who organizes, facilitates, encourages, promotes, or instigates a sideshow may be charged with aiding or abetting under subdivisions (b) and (c) even if not physically present, while preserving the savings clause referencing People v. Beeman.

Removed the reference to 'as amended by Section 1 of Chapter 503 of the Statutes of 2024' from the section heading for Vehicle Code Section 23109, simplifying the amendment language.
