AB 374 California Assembly · 2025-2026 Regular Session

K–14 classified employees: payment of wages: itemized statements.

Summary
Existing law requires the governing board of a school district and the governing board of a community college district, except as provided, to employ persons for positions not requiring certification qualifications or that are not academic positions, respectively, and to classify all of these employees and positions. Under existing law, those employees and positions are known as the classified service. Existing law requires the governing board of any school district, including city boards of education, and the governing board of any community college district, including city boards of education, to fix and order paid the compensation of persons a part of the classified service, as provided. Beginning with the 2026–27 school year, this bill would require a public school employer, defined to include the governing board of a school district, a school district, a county board of education, a county superintendent of schools, a charter school, an auxiliary organization, or a joint powers agency, as specified, and a community college district to (1) furnish to a classified school employee at the time of each payment of wages an accurate statement in writing and in a specified format that shows specified information, including, among other things, gross wages earned, all deductions, and all applicable hourly rates in effect during the payroll reporting period, as provided, (2) record the deductions made from the payment of wages and keep the record on file for at least 3 years at a specified location, and (3) afford current and former classified school employees the right to inspect or receive a copy of records pertaining to their employment, as provided.

MINOR
The enrolled version of AB 374 broadens the exemption from showing hourly rates and total hours worked on itemized wage statements for classified school employees. The prior version required that an employee's compensation be 'solely based on salary' AND that the employee be exempt from overtime under specific Labor Code or IWC provisions. The enrolled version simply requires that compensation be 'based on a monthly or yearly salary,' removing the overtime-exemption requirement and slightly widening the salary-based language. All other changes are formatting adjustments for the enrolled bill (removal of line numbers, addition of passage dates, governor approval block, and page header reformatting).
ELIGIBILITY

In both Section 45170(d)(1) and Section 88169(d)(1), the exemption from displaying hourly rates and total hours worked on pay stubs was broadened. The old text required that the employee's compensation be 'solely based on salary' AND that the employee be exempt from overtime under subdivision (a) of Labor Code Section 515 or an applicable IWC order. The new text only requires that the employee's compensation be 'based on a monthly or yearly salary,' removing the separate overtime-exemption condition and slightly expanding what counts as salary-based pay.

TECHNICAL

Removed redundant phrase 'by the classified school employee' after 'total hours worked' in both Section 45170(d) and Section 88169(d).

Formatting changes for enrolled bill status: removed line numbers, added Assembly and Senate passage dates (September 10 and September 9, 2025 respectively), added Governor approval block, reformatted page headers and footers, and removed the legislative vote/appropriation/fiscal committee summary lines.
