Public employees: notice: artificial intelligence performing service within scope of work.

Removed 'implement, or utilize' from the list of triggering actions in Section 3558.10(b). The 45-day notice to employee organizations is now required only before an employer develops, purchases, or requires the use of generative AI, rather than also before implementing or utilizing it.

The notice requirement now applies not only when a public employer 'utilizes' generative AI but also when it 'requires the use of' generative AI to perform a service within the scope of work of a represented job classification. This closes a potential gap where an employer could mandate employee use of GenAI without triggering the 45-day notice obligation.

A stray capital letter 'A' before subsection '(a)' in Section 3558.10 was removed, correcting a drafting error.

The entire amendment to Government Code Section 65010 (Planning and Zoning Law) was deleted. That provision had made a nonsubstantive change to how courts review procedural errors in land use proceedings, requiring a finding of prejudice and substantial injury. Its removal narrows the bill to only the public employment AI notice requirement.

A new subdivision (a) was added defining 'generative artificial intelligence' and 'artificial intelligence' by cross-reference to Section 11549.64, providing a statutory basis for what counts as generative AI under the notice requirement.

The section was restructured from a single unlettered paragraph into lettered subdivisions (a) and (b), with the notice requirement moved to subdivision (b). The substantive 45-day notice obligation is unchanged.

New Government Code Section 3558.10 requires public employers identified in subdivision (a) of Section 3555.5 to provide a recognized employee organization no less than 45 days' written notice before taking action to develop, purchase, implement, or utilize generative AI to perform a service within the scope of work of the job classification represented by that organization.
