Santa Clara Valley Transportation Authority: employee housing: transit-oriented joint development projects.

Section 100170 of the Public Utilities Code, which would have authorized VTA to accept contributions, grants, or loans from any public agency or the United States for employee housing projects, is entirely removed from the enrolled bill. The bill now only amends Sections 100001.5 and 100130.5.

The distance threshold for both 'employee housing project' and 'transit-oriented joint development project' definitions was narrowed from one-half mile to one-quarter mile from the external boundaries of a transit facility, reducing the geographic area where VTA can develop these projects.

Redundant and conflicting affordability restriction language in Section 100130.5(d) was cleaned up. The old text contained duplicate statements about deed restrictions and affordability periods for both rental (55 years) and for-sale (45 years) housing units. The enrolled version consolidates this into a single clear requirement: recorded affordability restrictions for at least 55 years (rental) or 45 years (for-sale).

The bill no longer adds a new Section 100023 to the Public Utilities Code. The 'employee housing' definition is now embedded within Section 100130.5 instead of standing alone.

The fiscal committee designation changes from 'no' to 'yes' and the state-mandated local program designation changes from 'no' to 'yes,' reflecting the new reporting obligation.

Employee housing projects are now defined as providing housing for VTA employees AND members of the public, not just VTA employees. However, VTA must retain the right to prioritize VTA employees over the public for occupancy.

The distance requirement for both employee housing projects and transit-oriented joint development projects is reduced from one-half mile to one-quarter mile from the external boundaries of a transit facility.

New fair housing compliance requirements are added, mandating that VTA employee housing projects comply with Government Code Chapter 15 (affirmative furtherance of fair housing), the Fair Employment and Housing Act, the Unruh Civil Rights Act, and the federal Fair Housing Act.

New definitions for 'lower income households' (referencing Health and Safety Code Section 50079.5) and 'moderate-income households' (referencing Health and Safety Code Section 50093) are added to the section.

A new requirement is added that VTA shall ensure compliance with the recorded affordability restrictions on employee housing units (55 years for rental, 45 years for for-sale).

A new annual reporting requirement mandates that VTA submit a report to the Legislature by December 31 of each year, including development plans and status of pending employee housing projects with details on unit counts, affordability levels, unit sizes, developer names, and density.

A state mandate reimbursement provision is added: if the Commission on State Mandates determines the act contains state-mandated costs, reimbursement to local agencies and school districts shall be made under Government Code Part 7 (Section 17500 et seq.).

The word 'lease' is added to the list of property actions VTA may take (acquire, plan, undertake, construct, improve, develop, lease, maintain, operate, or dispose of) for employee housing and transit-oriented joint development projects.

Section 100130.6 was entirely deleted. This section had authorized VTA to form, own, or participate in limited liability companies or joint venture partnership arrangements to plan, finance, construct, own, operate, or manage transit-oriented joint development projects or employee housing. Its removal eliminates VTA's ability to create separate legal entities for these projects.

New affordability deed restrictions: rental housing constructed by VTA must remain affordable to lower or moderate-income households for a minimum of 55 years, and for-sale housing must remain affordable for a minimum of 45 years. Both requirements must be recorded as deed restrictions.

A new definition of 'employee housing project' is added in Section 100130.5(a)(1), defining it as a housing development project (as defined in Government Code Section 65589.5(h)(2)) for VTA employees that is undertaken in connection with an existing, planned, or proposed transit facility and located one-half mile or less from the external boundaries of that facility. This ties employee housing eligibility to transit proximity.

The term 'employee housing' is replaced throughout with 'employee housing project,' and references to 'development projects' in Section 100170 are changed to 'employee housing projects,' narrowing the scope of what VTA can finance through public agency contributions, grants, or loans.

Section 100130.5 is reorganized from subdivisions (a) through (d) into subdivisions (a) through (e), with a new definitions subsection at the beginning and the land use compliance requirement moved to its own subdivision.

The distance threshold for transit-oriented joint development projects was expanded from one-quarter mile or less to one-half mile or less from the external boundaries of a transit facility, effectively doubling the geographic area where VTA can pursue such developments.

The amendment to Health and Safety Code Section 17912 (a nonsubstantive change to building standards provisions) was removed entirely from the bill, narrowing the bill's scope to only the Public Utilities Code.

Assembly Members Ahrens and Pellerin were added as coauthors of the bill.

Redundant and awkward language in Section 100170 was cleaned up, including removal of duplicated words (e.g., 'facilities. facilities') and simplification of a long phrase about federal and state legislation to simply 'any state or federal law.'

New Section 100023 of the Public Utilities Code defines 'employee housing' as rental housing for VTA employees (consistent with Government Code Chapter 6.3) or any for-sale housing project that promotes housing opportunities for VTA employees.

Section 100130.5 is amended to expand VTA's property acquisition powers beyond transit-oriented joint development projects to also include employee housing, and adds specific authorization for VTA to construct rental housing (as a local agency) and for-sale housing for employees.

Section 100001.5 legislative findings are amended to explicitly include 'affordable housing opportunities for the authority's employees' as part of VTA's authorized purposes, alongside transit-oriented joint development projects.

New Section 100130.6 authorizes VTA to form, own, or participate in limited liability companies or joint venture partnerships for transit-oriented development or employee housing. Requires governing board approval at a noticed public meeting, VTA must retain sufficient control over the entity, and meetings must comply with the Ralph M. Brown Act.

Section 100170 is amended to allow VTA to accept contributions, grants, or loans from any public agency or the United States for development projects under Section 100130.5 (which now includes employee housing), without limitation by other provisions requiring approval of indebtedness.
