The prohibition on providing voluntary consent to enter nonpublic areas of daycare facilities was expanded from applying only to 'an officer or employee of an agency conducting immigration enforcement' to applying to any 'law enforcement officer.' This makes the bill far broader in reach, covering police, sheriffs, and other law enforcement beyond just immigration agents.

The Assembly version prohibited immigration enforcement personnel from being stationed within 100 feet of the entrance of a licensed child daycare facility (except for tasks related to their own children) and made violation a felony punishable by up to $10,000 and 2, 3, or 5 years in prison.

The child daycare provision was simplified from two separate requirements (a 100-foot buffer for immigration enforcement personnel AND a warrant requirement for facility employees) to only the warrant requirement. The remaining provision still requires that immigration enforcement be presented with a valid judicial warrant, subpoena, or court order before entering nonpublic areas of licensed child daycare facilities.

The provision prohibiting elections officials from authorizing any agency or officer responsible for immigration enforcement or federal law enforcement to be stationed in the immediate vicinity of a polling place was entirely removed. The Assembly version also stated that an unlawful authorization would be null and void and not a defense to criminal charges.

The exceptions for peace officers at polling places were restructured. The Assembly version listed specific scenarios (responding to a presently occurring violent crime, responding to an immediate threat to life or health, or casting a vote). The Senate version replaces these with a broader exception: any peace officer 'conducting official business in the course of their public employment' or casting a vote.
