Legally protected activities.

Section 123469.5(a) removes the condition that the reproductive or gender affirming health care services 'would have been protected by this state if they had been undertaken in this state.' The only remaining condition is that the acts were permissible under the laws of the jurisdiction where the person was located. This broadens protection to cover more out-of-state conduct.

Section 1549.13 removes the exception that allowed the Governor to recognize an extradition demand if the demanding state alleged in writing that the accused was physically present in that state at the time of the crime and then fled. The prohibition on recognizing such extradition demands is now absolute (subject only to Sections 1548.1 and 1548.2).

The phrase 'federal law' was removed from the exception clause in Section 1549.13, which now references only Sections 1548.1 and 1548.2 as exceptions to the anti-extradition rule.

The entire proposed amendment to Penal Code Section 1549.1 was deleted. That provision would have allowed the Governor to extradite a person charged in another state if the acts at issue would be punishable under California law when the consequences occurred here. Its removal means the bill no longer creates a permissive extradition pathway for out-of-state charges related to protected activity.

The bill's scope narrowed from three sections (adding Health and Safety Code 123469.5, amending Penal Code 1549.1, and adding Penal Code 1549.13) to two sections (adding Health and Safety Code 123469.5 and adding Penal Code 1549.13).

The new Section 1549.13 now explicitly references Sections 1548.1 and 1548.2 at the start of its text, clarifying that the prohibition on recognizing extradition demands applies specifically to demands made under those statutory provisions.

Section 1549.13 now explicitly requires that the demanding state allege in writing that the accused was 'physically present in the demanding state at the time of the commission of the alleged crime.' The original text was grammatically incomplete and did not clearly specify this physical presence element.

Section 1549.1 had a drafting error where a period and redundant word ('demand') split the sentence incorrectly. The amendment removes these, producing one continuous sentence about when extradition may be granted for acts committed in California or a third state that result in a crime in the demanding state.
