The Parent's Accountability and Child Protection Act: online marketplaces: nitrous oxide.

Removed amendment history headers (dates of prior amendments in Senate and Assembly) and replaced with final passage dates for the Assembly (August 25, 2026) and Senate (August 24, 2026).

Added a Governor's approval block at the end of the bill, including fields for date, time, and signature by the Private Secretary of the Governor.

Removed the 'Introduced by' line naming Assembly Member Lowenthal and coauthor Petrie-Norris, along with the original introduction date of February 18, 2026.

The legislative counsel's digest was updated to remove the phrase 'as amended' after the bill number, reflecting that this is now the final enrolled text rather than an amended version.

The prohibition on allowing minors to purchase restricted products now covers both gift cards AND store credit, not just gift cards alone. This closes a potential loophole where a minor could use store credit to buy nitrous oxide or other restricted items online.

The definition of 'online marketplace' was removed from the bill. The old definition covered consumer-directed electronic platforms enabling third-party sales and excluded platforms with less than $1 billion in gross revenue. Removing this definition may change which entities are subject to the bill's requirements or shift reliance to definitions elsewhere in law.

The 'government-issued identification' definition was restructured from a confusing nested format (with duplicate numbering like '(1) Government-issued identification means any of the following: (A) (1)...') into a clean flat list of five items. No substantive change to what qualifies as acceptable ID.

The provision prohibiting online marketplaces from offering any listed product (firearms, tobacco, nitrous oxide, etc.) for sale to California customers is entirely removed. Online marketplaces are no longer banned from facilitating these sales.

Nitrous oxide is moved from the general products list (alongside aerosol paint, fireworks, tanning) to the weapons-and-tobacco category (alongside firearms, ammunition, e-cigarettes). This matters because the two categories have different required age-verification steps: the weapons-and-tobacco category does not require use of a nonprepaid credit card or minor account restrictions.

The regulatory exemption provision no longer references online marketplaces. It now applies only to 'a business' regulated by state or federal law providing greater age verification or personal information protection, rather than 'a business or online marketplace.'

The separate civil penalty of up to $1,500,000 per violation specifically for online marketplace violations is removed. Online marketplaces are now subject only to the standard $7,500 penalty (or up to $250,000 if annual gross revenues exceed $25 million).

The definition of 'online marketplace' (including the $1 billion gross revenue threshold and social media platform inclusion) remains in the bill but is no longer referenced by any operative provision, effectively making it dormant.

Online sellers are now prohibited from allowing a purchaser to use a gift card for products or services that are illegal to sell to a minor under state law (the first category: aerosol paint, etching cream, dangerous fireworks, UV tanning, ephedrine supplements, body branding, and nitrous oxide).

A new enforcement provision allows a public prosecutor to bring an action and seek a civil penalty of $7,500 per violation, with the court authorized to increase that penalty up to $250,000 per violation if the business had annual gross revenues exceeding $25 million in the preceding calendar year and the court finds the increase necessary to deter future violations.

Public prosecutors may now also seek injunctive relief and reasonable attorney's fees and costs recoverable by a prevailing plaintiff when bringing an action under this section.

Assembly Member Petrie-Norris was added as a coauthor of the bill.
