Pharmacy Law: advertising certain compounded medications used for obesity or weight management.

Added an entirely new Article 10.5 (Sections 4157 through 4157.5) to the Business and Professions Code, creating the 'Consumer Protection Compounding Act.' The bill now covers pharmacy compounding of weight-loss drugs in addition to the original trademark provision.

Added legislative findings specifically identifying foreign entities (naming China) as having exploited regulatory gaps to introduce inferior or contaminated API into the compounding supply chain, and noting that FDA enforcement has been insufficient to address the problem.

Requires compounders of GLP-1 receptor agonist drugs for obesity/weight management to use only pharmaceutical-grade bulk drug substances that meet USP/NF monograph standards (or FDA-approved drug components or FDA 503A(c)(2) list), accompanied by a valid certificate of analysis, with documented quality control testing for identity, content, and impurities above 0.1 percent.

Requires compounders to obtain proof that the bulk drug substance manufacturer is registered with FDA, was inspected by FDA within the last two years, and is not subject to an FDA import alert.

Makes it unlawful for manufacturers or wholesalers to sell bulk drug substances for compounding without providing written verification that the substance is pharmaceutical grade, meets sourcing requirements, passed quality testing, and has a valid certificate of analysis.

Requires all persons or entities selling compounded drugs to maintain records related to acquisition, examination, and testing of bulk drug substances for at least 2 years after the expiration date of the last lot, and to furnish those records to the board within one business day of request.

Makes it unlawful to advertise compounded medications unless the advertisement is truthful and not misleading, prohibits unsubstantiated claims about safety or efficacy, and requires disclosure of side effects, risk information from FDA-approved drug labeling, and a clear statement that the product is compounded and has not been approved or evaluated by the FDA.

Imposes a fine of $1,000 per dose of illegally compounded drug sold, transferred, or distributed, plus revocation of the person or entity's pharmacy or business license.

Grants the State Board of Pharmacy (or its authorized agents or approved third parties) authority to inspect any person or entity engaging in drug compounding or supplying bulk drug substances. Refusal to permit inspection constitutes a violation.

Defines 'bulk drug substance' (also known as active pharmaceutical ingredient or API) as any substance intended for incorporation into a finished drug product to furnish pharmacological activity, excluding intermediates used in synthesis. Also defines 'unsubstantiated claim' as a statement not supported by competent and reliable scientific evidence.

Changed fiscal committee impact from 'no' to 'yes' and state-mandated local program from 'no' to 'yes' because the bill now creates new crimes. Added a provision stating no reimbursement is required under the California Constitution because the costs arise from creating a new crime.

The article title was changed from 'Consumer Protection Compounding Act' to 'Consumer Protection Compounding Act Advertising Compounded Medications,' clarifying that the advertising provisions are a distinct component of the broader compounding safety framework.

The definition of 'compounded medication' in Section 4157.4(a)(1) was expanded from a simple cross-reference to Section 4157.1(a) to include an explicit description: 'a compounded drug that is a glucose-dependent insulinotropic polypeptide receptor or glucagon-like peptide-1 receptor agonist or other amino acid polymer intended to be used by humans for obesity or weight management.'

The advertising disclosure requirement in Section 4157.4(c)(1) was narrowed. The Assembly version required disclosure of side effects 'including any noted from clinical trials, research, and other appropriate information sources' in addition to FDA labeling. The Senate version removes the broader reference to clinical trials and research, limiting the disclosure obligation to information found in the labeling of FDA-approved drugs containing the same active ingredients.

Section numbering was corrected: 'SECTION 1.' was added before the article text (which previously had no Section 1 designation), and the former 'SEC. 3' was renumbered to 'SEC. 2.' The digest was also updated to reflect the advertising focus and reorganized for clarity.

A new scope-limiting provision was added to Section 4157 stating the article applies solely to compounded drugs that are GLP-1/GIP receptor agonists or other amino acid polymers intended for human use in obesity or weight management. All other compounded drugs are explicitly excluded.

The amendment to Section 14004 of the Business and Professions Code (regarding trademark registration by trade unions) was entirely removed from the bill. The short title no longer references business rights.

The manufacturer and wholesaler prohibition in Section 4157.1(b) was narrowed from applying to any bulk drug substance sold for compounding to only those sold 'for use in compounding a compounded drug specified in subdivision (a)' (i.e., obesity/weight management drugs).

A new exemption was added in Section 4157.5(b) providing that the article does not apply to physicians and surgeons licensed under Chapter 5 of the Business and Professions Code, though it clarifies this does not relieve them of other legal obligations.

A new definition of 'compounded medication' was added in Section 4157.4, limiting it to only the drugs specified in subdivision (a) of Section 4157.1 (i.e., obesity/weight management GLP-1/GIP agonists). This narrows the advertising and promotion restrictions accordingly.

The phrase 'generic equivalent' was inserted after 'similar drug' in the description of covered drugs, clarifying that the component must be from a generic equivalent of an FDA-approved obesity or weight management drug.

The fiscal committee designation changed from 'no' to 'yes' and the state-mandated local program designation changed from 'no' to 'yes', reflecting that the advertising provisions create a new crime requiring local enforcement.

Section 4157.4(c)(1) now requires disclosure of side effects, adverse reactions, contraindications, precautions, and warnings specifically from the labeling of any FDA-approved drug containing the active ingredients in the compounded drug, rather than from 'clinical trials, research, and other appropriate information sources.' It also adds an exception: the advertiser may omit a particular disclosure if they can demonstrate it is not relevant to the compounded drug.

The drug scope language was clarified from 'a component of a similar drug generic equivalent approved by the FDA' to 'a component of a generic equivalent approved by the FDA,' removing the confusing and redundant phrase 'similar drug.'

Corrected a duplicated drug name: 'glucagon-like-peptide-1 glucagon-like peptide-1 receptor agonist' was fixed to 'glucagon-like peptide-1 receptor agonist' in both the summary and operative text.

Fixed a drafting error in Section 4157.1 where the subdivision label read 'For (a)' instead of simply '(a).

Removed a duplicate word in Section 4157.4(b): 'medications medications' corrected to 'medications.'
