Public postsecondary education: students with disabilities: verification: academic accommodations.

Subsection (d) was cleaned up to remove a redundant and awkwardly drafted clause about ensuring academic requirements do not have a 'discriminatory affect or effect' against the student. The enrolled version uses a single, clearer standard: campuses may require supplemental information that is 'reasonably necessary to evaluate the student's request for academic accommodations and to determine the type of reasonable accommodations that are appropriate and best suited for the student's educational needs.' This slightly broadens the permissible basis for requesting supplemental information from a narrow non-discrimination purpose to a general reasonableness standard.

Legislative process formatting updated: header changed from amendment tracking to enrolled bill format showing passage dates (Senate Aug 24, Assembly Aug 25, 2026), removal of vote/appropriation/fiscal committee notation, and addition of governor receipt block. The legislative counsel's digest was reworded to remove 'as amended' language.

The entire amendment to Section 60901 of the Education Code (California Longitudinal Pupil Achievement Data System, pupil attendance data, chronic absenteeism reporting) was removed from the bill. The Senate version now deals only with disability verification for postsecondary academic accommodations.

A new definition for 'IPP' (Individual Program Plan) was added, referring to plans developed under Welfare and Institutions Code Section 4640 et seq., which are issued by regional centers that contract with the State Department of Developmental Services.

The types of documents accepted as disability verification were expanded. Previously only IEPs and 504 plans from local educational agencies (school districts, county offices of education, charter schools) qualified. Now IPPs issued by regional centers are also accepted, broadening the pool of students who can use existing documentation without obtaining new evaluations.

A new subdivision was added stating that an IEP, IPP, or 504 plan accepted under this section only verifies the existence of a disability. It does not require the institution to provide the specific accommodations, modifications, or services documented in that plan. The institution must independently determine and approve reasonable accommodations consistent with state and federal law and within existing institutional resources.

The provision on supplemental information was expanded to explicitly allow institutions to use it to assess functional limitations associated with the student's disability and to determine reasonable accommodations necessary for equal access to programs, services, and activities. This gives institutions more latitude in using supplemental information beyond just determining which accommodations are best suited.

Assembly Member Patel was added as a coauthor of the bill.

Adds new Section 67312.3 to the Education Code, expanding the bill's scope from solely pupil attendance data to also cover disability verification in public postsecondary education.

Explicitly applies the new section to the University of California notwithstanding Section 67400, which normally limits state legislative authority over UC.

Requires public higher education institutions (CCC, CSU, UC) to accept an IEP, 504 plan, or both issued by a local educational agency as valid verification of a student's disability when academic accommodations are requested. Effective September 1, 2027.

Prohibits public higher education institutions from requiring a student to obtain a new or additional diagnostic evaluation solely to verify a disability already documented in an IEP or 504 plan issued by a local educational agency. Effective September 1, 2027.

Authorizes campuses to require supplemental information from students solely for determining the type of reasonable accommodations best suited, but prohibits using that information to dispute or invalidate the underlying disability determination.
