Removed the reference to Penal Code section 191.5(a) from Vehicle Code section 1808(b)(1) in the immediately-effective amendment, meaning gross vehicular manslaughter while intoxicated with gross negligence will no longer be subject to the 10-year public disclosure period until January 1, 2031.

Removed paragraph (3) of Vehicle Code section 12810(d) in the immediately-effective amendment, which would have assigned three violation points to a conviction of Penal Code section 191.5(a). The three-point penalty for that offense is now only in the future-effective section operative January 1, 2031.

The 3-point violation tier in Section 12810(d)(3) was narrowed from covering multiple offenses (paragraphs (1) and (3) of subdivision (c) of Penal Code Section 192, which included insurance-fraud-related vehicular deaths and unlawful-act manslaughter) to only subdivision (a) of Section 191.5 (gross vehicular manslaughter while intoxicated with gross negligence). Offenses previously in the 3-point tier that are not 191.5(a) now fall into the 2-point tier under subdivision (d)(1).

All provisions of the bill are made operative on January 1, 2031 rather than taking effect immediately upon enactment. Both Section 1808 and Section 12810 include sunset clauses that repeal the interim versions as of that date, at which point newly added replacement sections become operative.

The bill was restructured from a simple amendment approach to a repeal-and-readd structure. The Senate version amends existing sections with sunset provisions (repealed January 1, 2031) and then adds new versions of both Section 1808 and Section 12810 that become operative on that same date. The act description was updated from 'amend' to 'amend, repeal, and add.'

The legislative counsel's digest was revised to accurately reflect the narrowed scope: the Assembly version described existing law as covering a broad set of vehicular manslaughter offenses (unlawful act, insurance fraud, VMI without gross negligence) all receiving 2 points with the bill increasing them to 3. The Senate version limits the description to VMI without gross negligence at 2 points and the new 3-point tier to gross VMI with gross negligence only.

The bill now amends Vehicle Code Section 1808 in addition to Section 12810, expanding its scope from a single provision about violation points to also address public access to DMV records.

New requirement that the DMV must make available or disclose abstracts of convictions and accident reports for gross vehicular manslaughter while intoxicated (Penal Code Section 191.5) within 10 years of the occurrence, matching the existing 10-year disclosure period for DUI-related violations.

The 3-point violation penalty in Section 12810(d)(3) now applies to convictions under Penal Code Section 191.5(a) (gross vehicular manslaughter while intoxicated generally) instead of Section 191.5(b) (the version with an additional gross negligence finding), broadening which drivers receive the higher point count.

Assembly Member Hadwick added as a coauthor of the bill.

Section 12810(d)(1) now assigns 2 points specifically to a conviction of subdivision (b) of Section 191.5 or paragraph (2) of subdivision (c) of Section 192 of the Penal Code, rather than the entire subdivision (c) as in the introduced version.

Section 12810(d)(3) now assigns 3 points specifically to a conviction of subdivision (b) of Section 191.5 or paragraph (1) or (3) of subdivision (c) of Section 192 of the Penal Code, rather than the entire subdivision (c) as in the introduced version.

The legislative counsel's digest was expanded to describe the specific vehicular manslaughter offenses covered, including driving in the commission of an unlawful act not amounting to a felony with gross negligence, and driving in connection with automobile insurance fraud where the collision was knowingly caused for financial gain and proximately resulted in death.
