The explicit protection for 'adjusting each other's clothing without removing articles of clothing' was completely removed from the list of permitted physical contact.

Kissing was narrowed from an unrestricted right to only 'kissing at the beginning and end of the visit, and brief kisses on the cheek or forehead during the visit.'

Hugging was changed from a general right to 'an embrace at the beginning and end of the visit,' though lateral holding or side-to-side contact remains permitted throughout the duration of the visit.

Touching of the face or hair was qualified by adding the word 'brief,' limiting it to brief touching rather than unrestricted face or hair contact.

The catch-all provision (former item 11) that protected 'any other physical touch that a reasonable person would define as nonsexual and appropriate' was removed, eliminating the open-ended safety net for unlisted forms of contact.

The word 'throughout' was removed from subdivision (a), changing 'nonsexual physical contact throughout during the visit' to 'nonsexual physical contact during the visit,' slightly narrowing the temporal scope of the anti-restriction requirement.

Legislative finding (13) was softened from asserting incarcerated people 'are regularly' denied parole due to excessive contact writeups to saying they 'could be' denied, reducing the strength of the stated justification.

New subdivision (d) requires department staff to provide a clear verbal warning and a reasonable opportunity to immediately correct conduct before terminating a visit, issuing a rules violation, or taking other disciplinary action based on alleged minor violations of inappropriate physical contact. If contact continues or excessive/unlawful activities occur, the department may take appropriate action.

The list of protected nonsexual physical contacts was made more specific: 'kissing' is now limited to kissing at the beginning and end of the visit plus brief kisses on the cheek or forehead; 'hugging' is now an embrace at the beginning and end plus lateral holding during the visit; 'touching of the face or hair' is now 'brief touching of the face or hair.'

New subdivision (e) states the section does not prohibit or discourage other forms of nonsexual physical contact that staff determine is reasonable, appropriate, and consistent with the section - a narrower safety valve than the removed catch-all.

New subdivision (f) clarifies that the section does not limit the department's authority to conduct searches, supervise visits, or impose restrictions necessary to prevent introduction or exchange of contraband.

Section 6400 was corrected to reference 'Department of Corrections and Rehabilitation' instead of just 'Department of Corrections.'

Findings language was softened: 'are regularly denied parole' changed to 'could be denied parole,' and 'Mandela Rules' was updated to 'Nelson Mandela Rules.'
