General plan: annual report: congregate and residential care for the elderly.

A new SEC. 1.5 was added that amends Government Code Section 65400 to require planning agencies to submit detailed annual reports to the legislative body, the Office of Land Use and Climate Innovation, and the Department of Housing and Community Development, covering housing element progress, production data, demolition reports, density bonus information, surplus land inventory, and many other data points.

A conditional operative clause was added specifying that the changes to Section 65400 are operative only if both AB 1567 and SB 1116 are enacted and AB 1567 is enacted last, creating a coordination mechanism between the two bills.

The amendment date was updated from August 19, 2026 to August 21, 2026, with the prior date retained as a secondary reference line.

New subparagraph (R) requires reporting on development status of land disposed under Section 54222.3.1, including square footage of residential and nonresidential development, low barrier navigation centers, number of permitted units and beds, and percentage restricted for low or moderate income households.

New subparagraph (S) requires reporting on the central inventory of surplus land that each county and city must maintain and report to the department under Section 54230.

New subparagraph (T) requires cities or counties that identify sites with permanent housing units on military bases undergoing closure or conversion as adequate sites under Section 65583.1 to address progress in meeting that section.

New subparagraph (U) requires reporting on the adequate sites program alternative as specified in paragraph (7) of subdivision (c) of Section 65583.1.

New subparagraph (V) requires a listing of city or county-owned sites from the Section 65583.2 inventory that were sold, leased, or otherwise disposed of in the prior year, including the transferee entity and intended use.

New subparagraph (W) requires reporting the number of housing units approved within a zone that comply with subdivision (c) of Section 65623 during the previous fiscal year.

New subparagraphs (X), (Y), and (Z) require reporting on units constructed under Section 65852.21, sites developed and units constructed under Section 65852.24, and applications for parcel maps for urban lot splits under Section 66411.7.

New subdivision (d) assigns the Office of Land Use and Climate Innovation authority to adopt standards, forms, and definitions for the non-housing-element portion of the annual report, with those standards exempt from the Administrative Procedure Act (Chapter 3.5).

The bill summary was updated to state that the bill would require local agencies to include in their annual report specified information related to the disposal of surplus land, reflecting the new reporting obligations.

An omission note was added stating that all matter omitted in this version appears in the June 18, 2026 Senate amendment (JR11), indicating some prior content was removed from this version and is presumably addressed elsewhere.

The ability of a planning agency to count approved units for congregate care for the elderly or residential care facilities for the elderly toward up to 15 percent of its regional housing need allocation is now conditional on those unit types being included in the regional housing need determination under Section 65584. Previously, the Assembly version allowed the count without that precondition.

Subdivision (a)(2)(B)(vi) now allows planning agencies to include units approved for residential care facilities for the elderly (defined in Health and Safety Code Section 1569.2) in addition to congregate housing for the elderly (defined in Section 50062.5), both counting toward the same 15 percent cap on a jurisdiction's regional housing need allocation for any income category.

The legislative counsel digest was updated from 'congregate care for the elderly' to 'congregate and residential care for the elderly' to reflect the expanded scope of qualifying facility types.
