Section 33319.6 was entirely deleted. This section would have required the State Department of Education to identify and post a list of approved literacy professional development programs by September 1, 2026, apportion funding to local educational agencies per full-time equivalent certificated staff, and require reporting on PD participation by September 1, 2029. This removed the bill's main funding and professional development mechanism.

Section 44270.7 was entirely deleted. This section would have required the Commission on Teacher Credentialing to certify by September 1, 2029 that all approved professional preparation programs and internships for administrative services candidates met specified literacy-related criteria.

New legislative intent provisions were added to Sections 44265.1, 44270.6, and 60205 stating that credential candidates and instructional materials should be prepared to support instruction in programs where English learner pupils are being instructed in their primary languages.

Throughout the remaining sections, references to the ELA/ELD Framework were expanded to include 'instruction to meet the varied language development needs of English learners,' and 'oral language development' was changed to 'oral and written language development.'

Section 44270.6 no longer requires alignment to the commission's current standards of program quality and effectiveness and teaching performance expectations (Sections 44259.6 and 44259.7). Section 60205 no longer requires alignment to guidance developed by a county office of education chosen by the Superintendent for followup adoption.

The deadline for the Commission on Teacher Credentialing to ensure administrative services program standards meet literacy criteria was pushed back from September 1, 2027 to September 1, 2028. The deadline for the state board to adopt instructional materials was moved up from June 30, 2027 to January 31, 2027.

The appropriation contingency for Section 60205 (instructional materials) was removed, meaning that section is no longer contingent on legislative funding. The overall bill digest also no longer states that implementation is contingent on an appropriation.

New Section 44265.1 requires the Commission on Teacher Credentialing to ensure that by January 1, 2028, its program quality standards and teaching performance expectations for the reading and literacy leadership specialist credential and reading and literacy added authorization include preparation on delivering instruction and supporting teachers through effective means for teaching literacy, aligned to the ELA/ELD Framework, evidence-based foundational reading skills instruction, and dyslexia program guidelines.

The criteria for instructional materials in Section 60205(b) were restructured. The evidence-based reading skills criterion now explicitly requires 'explicit and systematic instruction' language. A new criterion was added requiring materials that focus on specific skills or standards that are a subset of the ELA/ELD Framework to clearly designate which standards they effectively address.

The criteria for administrative services credential program standards in Section 44270.6 were restructured to separately require alignment to the commission's current standards of program quality and effectiveness and teaching performance expectations as specified in Sections 44259.6 and 44259.7.

The deadline for the commission to ensure administrative services credential program standards meet literacy criteria was extended from September 1, 2027 to September 1, 2028.

The deadline for the state board to adopt instructional materials in English language arts and English language development for kindergarten through grade 8 was moved up from June 30, 2027 to January 31, 2027.

New Section 60205(d)(2) allows a local educational agency to adopt a set of instructional materials that, in combination, address all state standards and components of the ELA/ELD Framework, rather than requiring a single unified set.

The bill now covers pupil literacy in addition to school facilities (HVAC). Four new Education Code sections (33319.6, 44270.6, 44270.7, and 60205) were added addressing professional development, credential standards, and instructional materials for reading instruction.

The bill now imposes state-mandated local programs on local educational agencies for both the HVAC inventory reporting and the new literacy-related duties, triggering potential reimbursement obligations under the California Constitution.

New Section 33319.6 requires the State Department of Education to make funds available and the Superintendent to apportion them to local educational agencies on a per-full-time-equivalent basis for certificated staff teaching transitional kindergarten through grade 5. Funds are usable from fiscal year 2026-27 through 2028-29.

All new provisions (Sections 33319.6, 44270.6, 44270.7, and 60205) are contingent upon an appropriation by the Legislature in the annual Budget Act or another statute.

Programs must be interactive, available in multiple modalities, include periodic mastery checks, and align with evidence-based reading instruction, the ELA/ELD Framework, and dyslexia program guidelines.

New Section 44270.6 requires the Commission on Teacher Credentialing to ensure that program standards for the preliminary administrative services credential include preparation on supporting teachers in delivering literacy instruction by September 1, 2027.

New Section 60205 requires the State Board of Education to adopt instructional materials for kindergarten through grade 8 in English language arts and English language development by June 30, 2027. Materials must align with evidence-based reading instruction, the ELA/ELD Framework, and dyslexia guidelines.

New Section 44270.7 requires the Commission on Teacher Credentialing to certify by September 1, 2029 that all approved professional preparation programs and internships for the administrative services credential meet literacy-related criteria.

Local educational agencies that adopt instructional materials not adopted by the state board must certify that those materials align to the specified literacy criteria. The state board must also update its Guidance for Local Instructional Materials Adoptions.

Coauthors were added (Muratsuchi, Blanca Rubio, Addis, Bonta, Hoover, Patel) and minor formatting changes were made to the existing HVAC section including renumbering of subdivisions and a hyphenation fix in the definition of HVAC.
