Swimming pool safety: building codes: condominium units.

All provisions requiring ticket sellers at venues with capacity over 1,000 to offer consumers an option to purchase all-day transit tickets are removed. This includes the addition of Section 22509.1 to the Business and Professions Code and the requirement for the Department of Transportation to study additional transit sales and report to the Legislature by December 31, 2032.

The term 'unit' is added as a covered property type throughout the bill alongside 'condominium unit or hotel room.' This means swimming pools or spas on private balconies, patios, or terraces of any 'unit' (not just condominium units or hotel rooms) are now subject to the same drowning prevention safety requirements as single-family home pools and excluded from public pool regulations.

Assembly Member Ahrens is removed as co-author and Assembly Member Lowenthal is removed as coauthor. The bill is now solely attributed to Assembly Member McKinnor.

The state-mandated local program designation is changed from 'no' to 'yes,' acknowledging that the bill imposes costs on local jurisdictions through increased building permit activity related to pool safety compliance.

The provisions authorizing the Santa Clara Valley Transportation Authority (VTA) to impose a $5 charge on ticket purchasers for 2026 FIFA World Cup and NCAA basketball events in Santa Clara County, and the Los Angeles County Metropolitan Transportation Authority (LA Metro) to impose a similar $5 charge for 2026 FIFA World Cup events in Los Angeles County, were deleted in their entirety.

The bill now extends drowning prevention safety feature requirements (at least 2 of 7 features such as enclosures, alarms, safety covers, etc.) to swimming pools and spas located on or within a private balcony, patio, or terrace of a condominium unit or hotel room, in addition to the existing requirement for single-family homes.

The definition of 'public swimming pool' in multiple Health and Safety Code sections (115921, 116025, 116049.1, 116064.2) was amended to explicitly exclude pools on private balconies, patios, or terraces of condominium units or hotel rooms, so those pools are not subject to public pool regulations (underwater lighting, antientrapment devices, etc.).

The California Building Standards Commission is required to publish the text of the Swimming Pool Safety Act in the California Building Code (not just the Residential Code) by March 1, 2027.

The State Department of Public Health must adopt implementing regulations by March 1, 2027. Until January 1, 2028, those regulations are deemed emergency regulations exempt from certain review requirements.

The bill is no longer an urgency statute and the vote requirement changed from a two-thirds majority to a simple majority. The fiscal committee answer changed from 'no' to 'yes.'

A new provision states that no state reimbursement is required because local agencies have authority to levy service charges, fees, or assessments sufficient to pay for the mandated program.

New Business and Professions Code Section 22509.1 creates a statewide requirement that ticket sellers or resellers of tickets to sporting, musical, theatre, or entertainment events at venues with capacity over 1,000 persons must offer consumers the option to purchase an all-day transit ticket from a provider serving the venue during the event.

The transit ticket option must be available whether the ticket is sold online or via mobile app, and must be listed as the first option on any website that also offers private vehicle parking.

Ticket sellers, resellers, or transit agencies may charge consumers a fee reasonably related to actual software revision costs needed to implement the transit ticket option.

Fiscal committee review changed from 'no' to 'yes,' indicating the new Caltrans study obligation was identified as having a fiscal impact.

A violation of the new Section 22509.1 explicitly does not constitute a misdemeanor, carving it out from existing ticket seller criminal penalties under Section 22505.

Caltrans must prepare a study of additional transit sales generated by the new provisions and report findings to the Legislature by December 31, 2032. The reporting requirement becomes inoperative on December 31, 2033.

A new Section 100116 was added authorizing VTA (Santa Clara Valley Transportation Authority) to impose a $5 ticket charge for sporting events in Santa Clara County. The qualifying events are the 2026 FIFA World Cup and the 2026 NCAA Men's or Women's Basketball Championship.

The LA Metro provision was narrowed: the definition of 'sporting event' now covers only matches held as part of the 2026 FIFA World Cup, removing the 2028 Olympic and Paralympic Games that were in the original bill.

Both VTA and LA Metro are now required to submit a report to the Legislature by January 1, 2027, detailing the charge amount, revenue collected, number of free trips taken, and additional transit services provided. The reporting requirement sunsets on January 1, 2031.

Explicit definitions of 'sporting event' were added for both agencies: for VTA it means any match in the 2026 FIFA World Cup or any game in the 2026 NCAA Men's or Women's Basketball Championship; for LA Metro it means any match in the 2026 FIFA World Cup.

Assembly Member Ahrens was added as a co-author and Assembly Member Lowenthal was listed as a coauthor. The bill title and digest were updated to reflect both counties.

The 2028 Olympic and Paralympic Games were removed from the definition of eligible sporting events for LA Metro's ticket surcharge. The charge now applies only to matches held as part of the 2026 FIFA World Cup in Los Angeles County.

A new Section 3 was added declaring the bill an urgency statute that takes effect immediately upon passage, rather than waiting until January 1 of the following year. The stated necessity is to enable early sales of tickets to 2026 FIFA World Cup games.
