The entity eligible for the exemption changed from a 'food processing establishment' (defined in Health and Safety Code Section 111955) to an 'agricultural crop preparation service' (defined in Title 13 of the California Code of Regulations, Section 3001). This narrows who can claim the exemption.

The standard for claiming the exemption changed from a vague 'historically has not disposed of organic waste to a landfill' to a specific requirement: the entity must demonstrate to CalRecycle, in a form and manner developed by the department, that it has not disposed of organic waste in a landfill on or after January 1, 2016.

A non-exhaustive list of organic waste types was added: culls, fruit skins, hulls, leaves, seed pits, shells, and sticks. This clarifies what counts as organic waste for purposes of the exemption.

The fiscal committee designation changed from 'no' to 'yes,' indicating the bill now carries a fiscal impact requiring fiscal committee review.
