Labor Commissioner: unpaid wage claim process.

Summary

Existing law establishes the Division of Labor Standards Enforcement, headed by the Labor Commissioner, within the Department of Industrial Relations, for the purpose of enforcing labor laws. Existing law authorizes the Labor Commissioner to collect unpaid wages and monetary benefits due to an employee. Existing law requires the Labor Commissioner to report annually to the Legislature regarding the amount of wages unlawfully withheld from workers and the amount of unpaid wages recovered for workers. This bill would, beginning July 1, 2021, require the Labor Commissioner to create an online portal on their internet website that would allow wage claimants to file unpaid wage claims, track those claims, and submit requested documents regarding those claims.
